Dire Consequences for Blacks, Others Groups Expected with Supreme Court Pick

Of all of President Donald Trump’s demagoguery against free speech, the press, religious rights, due process, and women’s control over their bodies, no decision carries such far-reaching and lasting consequences for women, people of color, and other groups, over generations than his Supreme Court pick of Judge Brett Kavanaugh.

“This Supreme Court nomination is the most consequential to be taken up in decades. Since Justice Sandra Day O’Connor’s retirement from the court, Justice (Anthony) Kennedy has been a critical swing vote on some of the most important civil rights issues to come before the court. This nomination stands to change the balance on the court for generations to come,” said Kristen Clarke, president and executive director of the Lawyers’ Committee for Civil Rights Under Law.

On a press conference call on Tuesday, Clarke said it was time for Senate Democrats to carry out their constitutional duty of fully and properly vetting Kavanaugh’s records. Trump, throughout his campaign for president, has publicly stated that he’d like to see Roe v. Wade, the landmark 1973 decision that legalized abortions nationwide, overturned. Last October, during the last presidential debate, he was asked his opinion on the issue.

“Well, if we put another two or perhaps three justices on, that’s really what’s going to be—that will happen,” Trump said at the debate. “And that’ll happen automatically, in my opinion, because I am putting pro-life justices on the court. I will say this: It will go back to the states, and the states will then make a determination.”


So far, the president has been able to get Neil Gorsuch, a conservative, on the Supreme Court bench. With Justice Anthony Kennedy’s retirement, whose votes helped swing decisions to the left on issues like abortion, affirmative action, and gay rights, Trump now has a pathway to select a second conservative justice onto the Supreme Court. This means civil rights cases will be some of the most monumental cases that will be brought before the Supreme Court for years to come, Clarke said.

If there is any doubt about what kind of long-lasting damage Kavanaugh’s confirmation to the Supreme Court bench could do to black and brown people’s civil and human rights, one need not look past Gorsuch’s record since being on the bench for only 11 weeks. The court struck down a law that treated LGBTQ couples differently on their children’s birth certificates. The court refused a challenge to the Department of Veteran Affairs’ system for evaluating disability claims. A challenge to California’s law limiting who can carry a concealed firearm in public was declined by the court. All of which Gorsuch dissented on, according to USA Today.

Kavanaugh, 53, has a dangerous track record of protecting the privileges of the wealthy and powerful at the expense of working people, AFL-CIO President Richard Trumka said in a statement. When asked about what his personal opinion on abortion was during his 2006 confirmation hearing for the D.C. Circuit Court, Kavanaugh declined to answer, saying: “I don’t think it would be appropriate for me to give a personal view on that case.”

On Abortion Rights: While the Appeals court in Washington allowed a detained undocumented immigrant minor to seek an abortion last fall, Kavanaugh, who dissented said the majority who voted “yes” had “badly erred” and created a new right for undocumented immigrant minors in custody to “immediate abortion on demand” according to the Washington Post.

Religion: A part of the Obamacare Act required insurers to cover contraception, but some employers objected on religious grounds. To avoid paying a fine, “employers can bypass the requirement by submitting a form to their insurers, which then cover the workers’ contraception at no expense to the employers.” Forcing employers to submit the form violated their religious liberty, Kavanaugh wrote, siding with religious organizations who contended that “even submitting the form made them complicit in providing contraception.”

Consumer Rights: Consumer advocacy groups are worried about Brett Kavanaugh, especially because of the history that he has with the Consumer Financial Protection Bureau (CFPB) arguing that the financial regulatory entity’s mere existence was unconstitutional. In 2014, CFPB alleged that mortgage company PHH Corp. had “harmed consumers through a mortgage insurance kickback scheme that started as early as 1995.” A year later, the company was ordered to pay $ 109 million in fines. PHH sued to have the fines vacated, and Kavanaugh was on a three-judge panel that ruled in favor of the company, taking issue with CFPB’s organizational set up.

Second Amendment/Gun Rights: In a 2011 case in which the DC Circuit court “upheld a ban that applied to semiautomatic rifles in the District of Columbia” Kavanaugh, who dissented from a majority opinion wrote that the Supreme Court had previously “held that handguns—the vast majority of which today are semi-automatic—are constitutionally protected because they have not traditionally been banned and are in common use by law-abiding citizens.”

Voting Rights: When South Carolina first tried to implement its now passed Voter ID law that required voters to present government-issued photo ID in order to cast a ballot in the 2012 elections, Kavanaugh was one of three panel judges who ruled to block its enforcement. The court, however, ruled that the state may put the law in effect in the future “to allow time to educate voters about the requirement.”

“At first blush, one might have thought South Carolina had enacted a very strict photo ID law,” wrote Kavanaugh. “Much of the initial rhetoric surrounding the law suggested as much. But that rhetoric was based on a misunderstanding of how the law would work.” The law, as construed by South Carolina officials, “does not have the effects that some expected and some feared,” the judge wrote.

Rev. Al Sharpton, who was on the press call on Tuesday said Kavanaugh’s confirmation process was moving too fast. Before Kavanaugh’s records are examined, Senate Democrats need to ensure that the “McConnell Rule” which Senate Majority Leader Mitch McConnell put in place and used to derail former president Barack Obama’s pick to the court a couple of years ago be applied at this go, he said.

“Not only are we very much concerned that we may now have a right-wing jurist given his record. We’re also concerned that the process itself is going through and no one is raising the fact that when Barrack Obama as president had nominated Garland, McConnell went ahead and very directly and openly changed the rules and they are allowing them to change the rules back,” said Sharpton. “Democrats are to stall and really wait until after the election because this is a premise that was set by McConnell and others in the last election, nomination process with Judge Garland.”

“The McConnell Rule” states that Supreme Court Justices will not be considered in an election year with McConnell saying, “the American people should have a voice in the selection of their next Supreme Court Justice. Therefore, this vacancy should not be filled until we have a new president.”

“We are calling on every Democrat to not leap with Kavanaugh. We are calling on them to bring the argument to the American people before we get to his credentials or anything else. The process itself is being politicized, which is opposite of what the court is supposed to do,” Al Sharpton said.

Since the court was established in 1789, there have been 153 nominations to the US Supreme Court, 30 of which were unsuccessful in their first try, and Clarke said Senate Democrats need to ensure Trump’s pick wait till the November elections are over.

“The Senate should not rubber-stamp the nomination of Judge Kavanaugh. It’s time for them to carry out their constitutional duty of fully and properly vetting him (Judge Kavanaugh),” she said.

Trump Nominates Brett Kavanaugh for the U.S. Supreme Court

President Donald Trump announced Brett -Kavanaugh as his Supreme Court nominee Monday night, in a primetime televised event. Judge Kavanaugh, a U.S. Circuit Court judge for Washington, D.C., would fill the vacant seat left by retiring Justice Anthony Kennedy, who announced his departure in late June.

Calling Trump’s Supreme Court nomination an “honor and privilege,” Kavanaugh addressed a crowd in the White House’s East Room alongside his wife and two daughters. “A judge must interpret the law, not make the law,” Kavanaugh said. If approved by the Senate, he would become the fifth conservative justice on the nation’s highest court.

On the issues, Kavanaugh seems to tick many of the boxes of interest to Trump, who included him on a list of potential Supreme Court picks published by the White House in November 2017.

Age was an important factor in making Trump’s Supreme Court list; Kavanaugh is 53 years old, which would guarantee a measure of longevity on the court, if he is approved by Congress.

Kavanaugh’s views on impeachment could be controversial and of interest to Trump. The Supreme Court nominee argued in the past that President Bill Clinton could have been impeached for lying to and misleading both his staff and the public at large. But after working in the George W. Bush administration, Kavanaugh’s stance has softened, reports The Washington Post. Kavanaugh now reportedly believes court proceedings against a sitting president should be deferred until after he or she is out of office.

“The indictment and trial of a sitting President, moreover, would cripple the federal government, rendering it unable to function with credibility in either the international or domestic arenas,” Kavanaugh wrote in a 2012 piece titled “Separation of Powers During the FortyFourth Presidency and Beyond” for the Minnesota Law Review.

In addition to opposing abortion rights, Kavanaugh is also reportedly against net neutrality, according to an article from Motherboard.

If confirmed, Kavanaugh will become Trump’s second Supreme Court appointment. Justice Neil Gorsuch was Trump’s Supreme Court pick in 2017.

Kavanaugh was among four potential nominees Trump interviewed for the lifetime appointment. The list also included Amy Coney Barrett, Amul Thapar and Raymond Kethledge. Thomas Hardiman, a runner up for Gorsuch’s seat, also reportedly met with Trump, reports TIME.

Feminists Can and Must Demand a Supreme Court Justice Who Answers on Roe

Donald Trump will soon announce his nominee to fill the Supreme Court seat Justice Kennedy will vacate later this month—and women’s rights are at stake.

Trump ran on a platform of outlawing abortion and even once said women who obtain them should be “punished,” and his nominee will come from a list hand-picked by the anti-feminist, right-wing Federalist Society. Trump himself has said that he wouldn’t be asking his nominee about Roe—but his commitment to appointing anti-abortion and otherwise anti-woman judges to the bench at every level of the judiciary is apparent. It is not Trump and his associates or the Republican party members in the Senate who need Justices to disclose and be accountable to their views in hearings—it is the Americans impacted by their regressive interpretations of the law.

Trump has already successfully appointed one far-right Justice: Neil Gorsuch last year assumed the vacated seat of the late Antonin Scalia, which was left open due to Senate Majority Leader Mitch McConnell’s outright refusal for an entire year to hold hearings on then-President Barack Obama’s nominee, Merick Garland. Gorsuch, who had a record of ruling in favor of corporations and against women’s rights, has already proven to be a staunchly conservative vote on the Court. In hearings, he refused to commit to a stance on Roe or even on Brown v. Board of Education.

A GOP-fostered lack of transparency in Supreme Court candidates has now become the norm—even as the rights of women, people of color and LGBT communities hang in the balance. Linda Greenhouse, winner of the Pulitzer Prize in Journalism and lecturer at Yale Law School, argued last week in the New York Times that Justice Gorsuch’s refusal to disclose his stance on past Supreme Court rulings was abnormal—and implores Democrats and Republicans to challenge rhetoric that inquiries about the views of Supreme Court nominees are somehow invasive.

With the future of the court—indeed, of the Constitution as we know it—now at stake, it’s urgent for the senators and the public to understand that Justice Gorsuch’s stonewalling of the Judiciary Committee was not consistent with historical practice and should not be viewed as a norm. Rather, it should be called out for what it was: a derogation of the democratic principle at the heart of Article III of the Constitution, the judiciary article that places the confirmation of life-tenured judicial nominees in the hands of the people’s representatives. Until recently, the modern confirmation process has assumed at least a modicum of substantive engagement between those representatives and the nominee.

Justice Gorsuch and his senatorial enablers based the claim that it would somehow be unethical for him to discuss his own views about the Constitution on something he and others referred to as the “Ginsburg rule.” Supposedly, during her 1993 confirmation hearing, then-Judge Ruth Bader Ginsburg refused to give meaningful answers to the senators’ questions. That is a myth. As the current documentary film “RBG” reminds us, she fully embraced the constitutional right to abortion. She was confirmed by a vote of 96 to 3.

Not only is there no “Ginsburg rule,” but the two Republican nominees who came after her, John G. Roberts Jr. and Samuel A. Alito, were both more forthcoming than Justice Gorsuch. While both fenced with the senators about Roe v. Wade and refused to be pinned down, they each accepted the holding in Griswold v. Connecticut, the crucial pre-Roe decision recognizing a right to privacy that gave married couples the constitutional right to contraception. “I feel comfortable commenting on Griswold and the result in Griswold,” then-Judge Roberts told Senator Herb Kohl, a Wisconsin Democrat, during his 2005 hearing, “because that does not appear to me to be an area that is going to come before the court again.” (Let’s hope that’s still the case.)

The high stakes of the announcement were nevertheless preceded by a day of wild speculation and tea leaf-reading, designed, some conservatives briefed on the nomination process believe, to prevent a leak of Trump’s decision by flooding the zone with contradictory information. It’s characteristic of a president who revels in the political press spinning its wheels, and is naturally inclined to the sort of primetime TV drama that he helmed as host of NBC’s The Apprentice.

Supreme Court Justice Anthony Kennedy Announces Retirement

In a move that could allow President Donald Trump to reshape the nation’s highest court for years to come, Supreme Court Justice Anthony Kennedy has announced his retirement. Kennedy sent a letter to Trump on Wednesday revealing his decision to retire as an Associate Justice of the Supreme Court, effective July 31st.

President Donald Trump has spoken to four potential replacements for retiring Supreme Court Justice Anthony Kennedy, according to people familiar with the matter.

The four, all federal appeals court judges, are Amy Coney Barrett, Brett Kavanaugh, Amul Thapar and Raymond Kethledge, said the people, who were granted anonymity to discuss the interview process. They were the first candidates interviewed for the nomination, which the president said he’ll announce July 9.

Kethledge has impressed those within the White House, the people close to the process said. He was considered for the last Supreme Court vacancy, but didn’t meet with Trump then. On Monday, Trump expressed strongly favorable opinions about him, triggering talk that he’s not a candidate to be ignored.

“I had a very interesting morning,” Trump told reporters at the White House. The “person that is chosen will be outstanding.”

White House Counsel Don McGahn will oversee the nomination and confirmation fight, Press Secretary Sarah Huckabee Sanders said in a statement earlier. Trump said again that he’ll name his nominee on July 9. The White House aims to have Kennedy’s replacement confirmed in time for the court’s next session in October.

The president spent the weekend at his Bedminster, New Jersey, golf resort, where he had “extensive” conversations with McGahn about the nomination, an administration official said. He studied up on the backgrounds of potential nominees but didn’t interview anyone in person.

Sanders’s top deputy, Raj Shah, will take a leave from his current role to oversee communications, strategy and “messaging coordination” with allied lawmakers, Sanders said Monday. The director of the White House Office of Public Liaison, Justin Clark, will be in charge of outreach to interest groups and other outside allies.

Trump has said he’s narrowed his search to about five finalists, including two women. Abortion has rapidly emerged as the critical issue in the nomination: Kennedy’s replacement could be a fifth vote to overturn the landmark 1973 Roe v. Wade decision.

Senator Susan Collins, a Maine Republican who supports abortion rights, said Sunday on ABC’s This Week that she wouldn’t support someone who would overturn Roe. Republicans hold 51 seats in the Senate and need at least 50 votes to confirm Trump’s pick.

Another person familiar with the process said Friday the White House was focusing on Kavanaugh, Barrett, Kethledge and Thapar, as well as Thomas Hardiman, another appeals court judge.

When Barrett was confirmed in 2017 for her appellate court judgeship, she drew the support of all Senate Republicans and three Democrats — Joe Manchin of West Virginia, Joe Donnelly of Indiana and Tim Kaine of Virginia.

“Teams of attorneys from the White House Counsel’s Office and Department of Justice are working to ensure the president has all the information he needs to choose his nominee,” Sanders said. “The Department of Justice is fully engaged to support the nomination and confirmation efforts.”

Why You Must Let Your Voice Be Heard On Trump’s Supreme Court Replacement

The most recent action involving the Supreme Court that’s expected to impact the nation for a generation or more has not been the result of a major decision but rather a resignation.

On Wednesday, Justice Anthony Kennedy announced that he would step down from the nation’s high court—a move that presents President Trump with the opportunity to ideologically remake the bench by solidifying a predictably conservative majority to rule on a range of issues critical to American life.

Why should you be concerned?

The effect on the legal landscape will be seismic. it will affect every case that comes before the court—from immigration status and reproductive rights to workplace inclusion and voting rights—for decades to come. It’s evident from the response to this development that it serves as a political windfall for Republicans as Senate Majority Leader Mitch McConnell immediately stated that the GOP “will vote to confirm Justice Kennedy’s successor” in advance of the midterms, making the declaration even before Trump has reviewed a possible replacement.

A Reagan appointee who served for 30 years, Kennedy was considered a swing vote on a number of key cases. For example, he disappointed archconservatives for positions that tended to place him closer to the center. For example, he wrote the ruling that legalized same-sex marriage in 2015, joined opposing justices against the death penalty in 2005 and was among those who upheld Roe v. Wade in 1992. However, don’t overlook the fact that he sided with conservative justices on the court’s 14 most recent decisions.

Judging by his lower court selections, Trump will most certainly pick a hardline conservative to fill the vacancy and join Chief Justice Roberts, Clarence Thomas, Samuel Alito, and Neil Gorsuch, the president’s first appointment to the Supreme Court. As observers have noted Ruth Bader Ginsburg and Stephen Breyer, both consistent liberals on the court, are 85 and 79, respectively, and potentially represent near-term successor opportunities for the administration to significantly diminish any progressive dissent within chambers.

Justifiably, progressives view the scenario as a means to erode the current civil rights agenda as well as a judicial fiat of the continuation of Trump’s largely unchecked presidential authority. As we commemorate the 150th anniversary of the 14th amendment, which guarantees all citizens “equal protection under the law” and has served as the basis for landmark Supreme Court decisions to ensure basic rights, one only has to look to the Supreme Court decisions this month to realize the further rollback of rights that will leave all Americans unprotected, especially people of color. In this month alone, the high court’s current conservative-leaning configuration engaged in a series of restrictive rulings that included allowing Ohio to employ aggressive policies to purge voting rolls and open the door for other states to impose similar measures; validation of the redrawing of electoral maps in Texas and North Carolina that critics argue will serve to discriminate against minority voters; weakening public sector labor unions and, in turn, disproportionately hurting large numbers of black workers when it deemed unconstitutional a requirement for non-union workers to pay collective bargaining fees; and permitting the Trump administration to continue its anti-Muslim travel ban that limits entry from seven countries including Iran, North Korea, Syria, Libya, Yemen, Somalia, and Venezuela.

So what can you do?

NAACP Legal Defense Fund President and Director-Counsel Sherrilyn A. Ifill provides an answer.

In a statement, Ifill cited that Kennedy proved to be “an important moderating force on issues ranging from LGBT rights to abortion and affirmative action” whose presence on the Court will be missed. She further asserted that “we can have no confidence that President Trump will present a nominee with a record of commitment to racial equality and justice. And so every American must invest themselves in ensuring that Congress does its job—which in this case, means not considering any nominee this year, and voting down any nominee who does not represent the ideals of our democracy or is otherwise unqualified to serve on the highest court in our nation.”

To ensure that the Senate engages in its “advise and consent” power to ensure Kennedy’s successor will “uphold the rule of law and equal rights for all Americans” she advocates that you contact U.S. Senators and demand that the incoming Senate—those for whom Americans will vote for in the midterms—gain the opportunity to vote for the confirmation of the next Supreme Court justice.

I agree that we cannot sit on the sidelines. We must take action. It will not be easy but we must constantly prod our representatives and make our voices heard.

To take a chapter from history, in 1987, Reagan nominated Robert Bork, considered an “ideological extremist” replacement for Lewis F. Powell Jr., another retiring, swing-voting justice. The nomination of Bork, who was considered unqualified and had derided judicial redress to racial discrimination as being “wrong,” ignited a firestorm of protest among civil rights organizations, women’s groups, and students, among others, as well as full-throated condemnations from Democrats and other progressive politicians. The result was that the nomination was rejected in committee, political support had evaporated and the confirmation was ultimately scuttled.

Democrats Want to Fight Trump’s Supreme Court Pick. They Just Have No Power to Do It.

Senate Majority Leader Mitch McConnell (R-KY) on Wednesday vowed to hold a vote on Supreme Court Justice Anthony Kennedy’s successor this fall, setting up a contentious political battle ahead of the critical midterm elections.

But while Democrats insisted that Kennedy’s replacement should not be considered until after voters have their say in November, many members of the party acknowledged the ominous political reality they now confront. Democrats are powerless to stop President Donald Trump from getting his second justice on the nation’s highest court.

“They hold all the cards,” said Jim Manley, a top aide to former Senate Majority Leader Harry Reid (D-NV). “There’s not really anything left to say.”

How the Supreme Court Ruling on Labor Unions Will Affect Black Workers

Dealing a major blow to public sector labor unions, conservatives on the Supreme Court on Wednesday ruled that it is unconstitutional for public employee unions to require non-union workers to pay fees that go toward collective bargaining.

According to the Washington Post, the 5-4 decision “overturned a 40-year-old precedent and said that compelling such fees was a violation of workers’ free speech rights.” 

“It is hard to estimate how many billions of dollars have been taken from nonmembers and transferred to public-sector unions in violation of the First Amendment. Those unconstitutional exactions cannot be allowed to continue indefinitely,” Supreme Court Justice Samuel Alito wrote for the majority, joining Chief Justice John G. Roberts Jr. and Justices Anthony M. Kennedy, Clarence Thomas and Neil M. Gorsuch.

Those who are pro-labor were quick to point out the adverse effects the ruling would have on labor unions and the working class.

“Unions will always be the most effective force and vehicle to propel working people into the middle class. Despite this unprecedented and nefarious political attack—designed to further rig the rules against working people—nothing changes the fact that America needs unions now more than ever,” said Lee Saunders, president of the American Federation of State, County and Municipal Employees.

Many feel that anything that weakens labor unions will disproportionately affect black workers.

“The aggressively activist decision today by five members of the Supreme Court in Janus is an attack on unions and working families that will further rig our economy and democracy in favor of corporations and billionaires. Today’s decision further threatens the economic security of working people, including women and people of color, by weakening the ability of public sector union members like firefighters, teachers, social workers, and police officers to earn a decent living,” Seema Nanda, executive vice president and COO of The Leadership Conference on Civil and Human Rights, said in a statement.

“We must continue to organize, hold our elected leaders accountable, and fight back against efforts to weaken America’s middle class. Unions play a critical role in securing higher wages, improved access to health care, anti-discrimination policies, and equality in the workplace,” Nanda continued.

The National Black Worker Center Project (NBWCP), a national organization focused on addressing the multi-dimensional job crisis for black workers, said the ruling, “would have allowed public employee unions to … cover the costs of collective bargaining and enforcing contracts that protect all workers.”

“To be clear, African Americans have as much at stake in maintaining strong unions as anyone with regards to economic security, affordable healthcare and retirement benefits. But, the union advantage disappears with Supreme Court decision and changes the landscape for the 20% of African Americans who work in public sector jobs. The implications of the Supreme Court siding with Janus in this case means that workers will face the uncertainty of stagnate or diminished wages, job insecurity and the possibility of retiring into poverty.”

[Breaking] Al Sharpton Blasts Supreme Court Decision to Uphold Muslim Travel Ban

On Tuesday, the Supreme Court ruled to allow the Trump administration to continue a travel ban restricting entry from seven countries including Iran, North Korea, Syria, Libya, Yemen, Somalia, and Venezuela, reports CNN and other news outlets.

Rev. Al Sharpton condemned the ruling through a statement released by the National Action Network:

“Today’s Supreme Court decision marks another outrageous step backwards for religious and racial justice around the world. The Supreme Court’s decision to the anti-Muslim bias clearly apparent in this policy is unfathomable—the ban is rooted in islamophobia and has been phonily sold to the American public for the sake of ‘security.’

“Trump has made it clear time and time again he wants a migration ban on individuals from all Muslim countries. We at NAN have no patience for the ongoing efforts by this administration to undermine religious freedom, a basic building block of our nation. We will push back at every step and every available juncture on any whiff of intolerance and prejudice.”

Since early 2017, the administration has attempted to enact a travel ban against mostly Muslim nations, several times. Each time, the action was struck down by federal judges, reports ABC News. The latest ban, which is the one the court upheld, was the result of a signed Executive Order in September.

The ruling comes on the heels of a week of outrage and protests over the Trump administration’s “zero-tolerance” immigration policy. The administration began prosecuting as many people crossing the border as possible. Many of these migrants cross the border with children. The Washington Post explains, when the adults are prosecuted, they are taken into Department of Homeland Security (DHS) custody. The children are separated from the adults, their parents, in most cases, and are placed in internment centers or “tender age” shelters since children cannot be detained by DHS.

With much of the public outraged over the detainment of children, President Donald Trump signed an Executive Order to stop the separation of children and parents but said zero-tolerance would continue.

Venus Williams Is Still in the Game—On and Off the Court

Venus Williams has tuned out all manner of distractions on her way to becoming one of the most successful women to set foot on a tennis court. But on a recent June morning in downtown New York City, there was no competing with the doe eyes of her 11-year-old Havanese, Harry, as he peeked his head out of her backpack. “Hi, good morning again,” Williams cooed as she buried her face in Harry’s fur. “You’re awful cute, aren’t you?”

As Harry gazes at her, Williams snaps back to attention and explains why, at age 38, with seven major tournament titles, a successful clothing brand and an interior-design business to her name, she keeps grinding away on the tennis tour. “I think you see some players, they’re clearly not playing well and they can’t keep up and they just can’t compete,” Williams says. “This is not a problem that I have.”

Williams is putting it modestly. More than two decades after her pro debut and seven years after being diagnosed with Sjögren’s syndrome, an autoimmune disorder that causes pain and fatigue, Williams is still among the game’s elite. In 2017 she reached the final of two Grand Slam tournaments and a semifinal of a third. This season has been rougher–she fell in the first round at both the Australian and French Opens. But if history is any guide, Wimbledon, which starts on July 2, could be the antidote.

The manicured grass of the All England Club has been particularly kind to Williams. Aided by her knack for running down balls on the fast surface that sneak past other players, she has won the singles title five times and, paired with sister Serena, the doubles title six times. (“Those titles count,” Williams says, smiling.) Those matches included some of the most memorable in recent history, including the three-set classic over Lindsay Davenport in the 2005 final and her straight-set triumph over Serena in ’08. Last July, Williams became the oldest Wimbledon finalist since Martina Navratilova in 1994.

Wimbledon is significant for another reason: it’s where Williams took a stand for equal prize money that helped the women achieve pay parity with the men. The day before she won the 2005 title, Williams addressed the Grand Slam Board, made up of executives from the four major events, in the boardroom at the august All England Lawn Tennis and Croquet Club. At that time, only the U.S. Open and the Australian Open offered equal prize money for men and women; Wimbledon and the French Open were still holding out. She gazed at the tennis pooh-bahs and asked them to close their eyes and follow her on a thought experiment. “You feel like you’re going against people who maybe have made up their minds already,” Williams says, recalling the moment. “I felt like I had to say something that was very humanizing because these people on the board, they have mothers, they have daughters, they have sisters. They have to remember that these women who are not getting equal prize money are mothers and daughters and sisters. You have to look at it that way, or else you might not be able to see through it.”

In April 2006, the French Open announced it would close its pay gap and offer both champions the same prize money. Wimbledon, however, stood firm. So Williams took her crusade public, writing in a June 2006 op-ed in the Times of London: “I feel so strongly that Wimbledon’s stance devalues the principle of meritocracy and diminishes the years of hard work that women on the tour have put into becoming professional tennis players.”

Williams’ crusade helped convince British Parliament to take up the issue. Prime Minister Tony Blair called for equal prize money. In early 2007, Wimbledon changed its policy. “It all happened so quickly,” Williams says. “We all thought we were going to fight for a lot more years.” This year the men’s and women’s champions will each earn around $ 3 million.

The debate, however, still rears its head. Rafael Nadal, who won his 11th French Open title in June, recently suggested that there can be reasons for pay disparities in a field. “Female models earn more than male models and nobody says anything,” Nadal told an Italian magazine. “Why? Because they have a larger following. In tennis too, who gathers a larger audience earns more.” When I read Nadal’s comments to Williams, she declined to return serve. “I don’t know anything about modeling,” she says. “I guess that’s a metaphor that makes sense to him.”

Williams is well aware that the pay gap is far from closed outside of tennis. American women earn 80¢ for every dollar taken home by men. “There’s still a lot of work to be done,” says Williams. “But men have to want it just as much as women. That’s very important. Looking back on the push for equal pay, Williams says she is an unlikely trailblazer. “I’m not necessarily a person who’s looking to be a leader in the middle of a crowd,” she says. “My job puts me in the middle of the crowd, but it’s not really how I live my life. But I’m also the kind of person that if you start a fight with me, then trust me, I’m going to end it. Don’t start anything with me.”

A decade ago, few would have wagered that the Venus and Serena would still be playing competitive tennis, let alone thriving in tournaments. They were rare talents, sure, but critics said the sisters had too many outside interests. And many wondered how Williams would be able to continue to play at the top level after her Sjögren’s-syndrome diagnosis. Williams did explore life beyond the court. She earned degrees in business and fashion design. “Not being more than an athlete was considered a failure in my household,” she says.

But it turns out that in refusing to pile up on tournament appearances in their 20s, the Williams sisters were able to flourish into their 30s. “It’s about planning a smart schedule,” says Williams. “A lot of people didn’t do that. Mental burnout is just as bad as physical burnout. Maybe worse.”

At last year’s Wimbledon, Williams broke down in tears after a reporter asked her about a incident that had occurred weeks earlier, when she was involved in a car accident in Florida that took the life of another car’s passenger. In December, police cleared Williams of any criminal wrongdoing. The deceased man’s family has filed a wrongful-death lawsuit against Williams, who declined to talk to TIME about the case.

Pundits have written millions of words, and filled hours of airtime, explaining the meaning of the sisters to their sport, and society at large. Williams is far less inclined to do the same. Asked how she would describe her impact, Williams deflects introspection like an errant ball. “Oh my gosh, I have to work on my wide serve,” Williams says. “Why am I not moving faster? Those are the things I think about. I don’t sit back and reminisce on any achievement, because that’s the past. And I don’t live in the past.”

Cyntoia Brown Case: Life Sentence Headed To Federal Appeals Court

CINCINNATI (AP) — Federal appeals judges said Thursday they’re considering asking the Tennessee Supreme Court to clarify whether a woman serving a life sentence for killing a man when she was 16 can ever gain parole.

The three-judge 6th U.S. Circuit Court of Appeals panel heard arguments Thursday in the case of Cyntoia Brown, who has attracted celebrity support.

Attorney Mark Pickrell said Tennessee’s laws “are completely ambiguous” on parole eligibility and that her sentence is unconstitutionally excessive. John Bledsoe of the Tennessee attorney general’s office disagreed, saying she has the possibility for parole after serving 51 years.

The U.S. Supreme Court has ruled against mandatory life-without-parole sentences for juveniles, but Tennessee has argued successfully in lower courts that Brown will have a chance for parole.

“The law is not unclear,” Bledsoe said.

Brown, now 30, would be 68 after serving 51 years. Pickrell said she could be told decades from now that the state considers her ineligible for parole if the appeals court lets stand now what he says is an unconstitutional sentence.

“That kind of miscarriage of justice should not be on the table,” Pickrell said.

Judge Amul Thapar said the appeals court could certify the question of her eligibility for Tennessee’s high court to answer before ruling. The judges didn’t say how soon they will act. The 6th Circuit hears appeals cases from Kentucky, Michigan, Ohio and Tennessee.

There was no discussion during the oral arguments on the other part of Brown’s appeal: Her attorneys contend she lacked the mental state to be culpable in the 2004 slaying, impaired by her mother’s alcohol use while she was in the womb.

Her attorneys say Brown has turned her life around. They have a request for clemency pending before Tennessee Gov. Bill Haslam.

Celebrities, including Kim Kardashian and singer Rihanna, are part of a social media campaign to get Brown released.

Advocates say she was a teen sex trafficking victim who received an extremely harsh sentence. Police have said she shot real estate agent Johnny Allen, 43, in the back of the head at close range after bringing a loaded gun to rob him.

Shawn “Jay-Z” Carter has a court order to appear in Manhattan federal district court today to testify about his joint venture with Iconix Brand Group Inc., which is under a Securities and Exchange Commission (SEC) probe. Attorney’s representing the hip-hop icon, however, accused the SEC of going on a “celebrity hunt” by demanding the rapper answer unlimited questioning about his business dealings.

Iconix Brand Group—which acquired Rocawear, the apparel brand that Carter founded in 1999—is being investigated for allegedly violating federal securities laws in its financial reporting. Although Carter sold Rocawear to Iconix back in 2007 for $ 204 million in intangible assets, it still maintains a joint venture with Jay-Z’s company Roc Nation, according to Iconix’s most recent financial filing. Roc Nation hasn’t received royalties from the partnership since 2015. The SEC is seeking Carter’s testimony on the deal to investigate inconsistencies in Iconix’s reporting, but Jay-Z’s reps argue that he should not be involved in the case at all since he had no role in Iconix’s financial reporting.

“We are aware that the SEC is seeking information on Iconix’ s financial reporting. Mr. Carter had no role in that reporting or Iconix’ s other actions as a public company. Mr. Carter is a private citizen who should not be involved in this matter,” reads a statement from Roc Nation provided to NPR last week.

In a court filing on Monday, Carter’s lawyer wrote that he has agreed to testify before the regulatory agency for just one full day of questioning, rather than for multiple days as determined and demanded by the SEC. “The SEC continues to insist on meeting Mr. Carter in person for an unlimited period of time,” wrote attorney Alex Spiro in a legal memorandum. Spiro argued that the request “imposes unreasonable burdens on Mr. Carter” as he prepares for his upcoming 4:44 tour. The attorney also questioned the intent behind the SEC’s demands and argued that the upshot has turned “into a celebrity hunt.” Jay-Z opposes the SEC’s demand based on his concern that open-ended, in-person testimony “is driven more by governmental fascination with celebrity and headlines than by any proper investigative purpose,” added Spiro.

The SEC initially issued two subpoenas for Jay-Z’s testimony in November 2017 and February 2018. The Brooklyn-born rapper neglected to comply both times, leading the SEC to file an enforcement action ordering him to show up in court for a hearing on May 8. However, refusal to comply with the subpoenas may have given him an advantage since he can now challenge the scope of information sought by the subpoenas during the hearing.

“This allows Jay-Z to argue, and a neutral judge to rule, that the boundaries of the subpoena should be narrowed considerably,” writes entertainment attorney Allen Secretov. “This route would practically not have been available if the investigation was kept out of the court system by Jay-Z’s initial compliance.”

SEC attorneys are scheduled to file a response on Tuesday right before the hearing.

Questions Of Sales Tax On Online Purchases Goes To High Court

WASHINGTON (AP) — Sales Tax: $ 0.

Online shoppers have gotten used to seeing that line on checkout screens before they click “purchase.” But a case before the Supreme Court could change that.

At issue is a rule stemming from two, decades-old Supreme Court cases: If a business is shipping to a state where it doesn’t have an office, warehouse or other physical presence, it doesn’t have to collect the state’s sales tax.

That means large retailers such as Apple, Macy’s, Target and Walmart, which have brick-and-mortar stores nationwide, generally collect sales tax from customers who buy from them online. But other online sellers, from 1-800 Contacts to home goods site Wayfair, can often sidestep charging the tax.

More than 40 states are asking the Supreme Court to reconsider that rule in a case being argued Tuesday. They say they’re losing out on “billions of dollars in tax revenue each year, requiring cuts to critical government programs” and that their losses compound as online shopping grows. But small businesses that sell online say the complexity and expense of collecting taxes nationwide could drive them out of business.

Large retailers want all businesses to “be playing by the same set of rules,” said Deborah White, the president of the litigation arm of the Retail Industry Leaders Association, which represents more than 70 of America’s largest retailers.

For years, the issue of whether out-of-state sellers should collect sales tax had to do mostly with one company: Amazon.com. The online giant is said to account for more than 40 percent of U.S. online retail sales. But as Amazon has grown, dotting the country with warehouses, it has had to charge sales tax in more and more places.

President Donald Trump has slammed the company, accusing it of paying “little or no taxes” to state and local governments. But since 2017, Amazon has been collecting sales tax in every state that charges it. Third-party sellers that use Amazon to sell products make their own tax collection decisions, however.

The case now before the Supreme Court could affect those third-party Amazon sellers and many other sellers that don’t collect taxes in all states — sellers such as jewelry website Blue Nile, pet products site Chewy.com, clothing retailer L.L. Bean, electronics retailer Newegg and internet retailer Overstock.com. Sellers on eBay and Etsy, which provide platforms for smaller sellers, also don’t collect sales tax nationwide.

States generally require consumers who weren’t charged sales tax on a purchase to pay it themselves, often through self-reporting on their income tax returns. But states have found that only about 1 percent to 2 percent actually pay.

States would capture more of that tax if out-of-state sellers had to collect it, and states say software has made sales tax collection simple.

Out-of-state sellers disagree, calling it costly and extraordinarily complex, with tax rates and rules that vary not only by state but also by city and county. For example, in Illinois, Snickers are taxed at a higher rate than Twix because foods containing flour don’t count as candy. Sellers say free or inexpensive software isn’t accurate, more sophisticated software is expensive and that collecting tax nationwide would also subject them to potentially costly audits.

“For small businesses on tight margins, these costs are going to be fatal in many cases,” said Andy Pincus, who filed a brief on behalf of eBay and small businesses that use its platform.

The case now before the Supreme Court involves South Dakota, which has no income tax and relies heavily on sales tax for revenue.

South Dakota’s governor has said the state loses out on an estimated $ 50 million a year in sales tax that doesn’t get collected by out-of-state sellers.

In 2016 the state passed a law requiring those sellers to collect taxes on sales into the state, a law challenging the Supreme Court precedents. The state, conceding it could win only if the Supreme Court reverses course, has lost in lower courts.

South Dakota says the high court’s previous decisions don’t reflect today’s world. The court first adopted its physical presence rule on sales tax collection in a 1967 case dealing with a catalog retailer. At the time, the court was concerned in part about the burden collecting sales tax would place on the catalog company. The court reaffirmed that ruling in 1992.

It’s unclear how the justices might align on the question this time. But three justices — Neil Gorsuch, Clarence Thomas and Anthony Kennedy — have suggested a willingness to rethink those decisions. Kennedy has written that the 1992 case was “questionable even when decided” and “now harms states to a degree far greater than could have been anticipated earlier.”

“Although online businesses may not have a physical presence in some states, the Web has, in many ways, brought the average American closer to most major retailers,” he wrote in suggesting the days of inconsistent sales tax collection may be numbered. “A connection to a shopper’s favorite store is a click away regardless of how close or far the nearest storefront.”

Maryland Redistricting Case Comes Before Supreme Court

WASHINGTON (AP) — The Supreme Court is taking up its second big partisan redistricting case of the term amid signs the justices could place limits on drawing maps for political gain.

The justices are hearing arguments Wednesday in an appeal filed by Republicans in Maryland. They complain that Democrats who controlled the state government in 2011 drew a congressional district for the express purpose of ousting the Republican incumbent and replacing him with a Democrat.

In Wisconsin, Democrats are challenging legislative districts drawn by Republicans statewide. Those districts gave Republicans a huge majority in a state that otherwise is closely divided between the parties.

The Supreme Court has never struck down districts for being too partisan.

A decision in favor of opponents of partisan gerrymandering could cut into the political power of the dominant party in states in which one party controls the state government.

The court is expected to issue decisions in both cases by late June.

Maryland’s 6th Congressional District had been centered in rural, Republican-leaning northwestern Maryland and had elected a Republican to Congress for 20 years. Incumbent Rep. Roscoe Bartlett won re-election in 2010 by 28 percentage points.

But in the 2011 redistricting, Democrats altered the district to take in some Democratic suburbs of Washington, D.C. The new district had 62,000 fewer Republicans and 33,000 more Democrats. Bartlett lost the 2012 election by 21 percentage points.

Republican voters who sued over the changes said the state violated their First Amendment rights.

Maryland Attorney General Brian Frosh, a Democrat, is defending the district as competitive for both parties. Frosh said the district has elected a moderate Democrat, and in 2014, a friendlier year for Republican candidates, the victory margin of Democratic Rep. John Delaney dropped to less than 2 percentage points, though it rose again in 2016.

Republican Gov. Larry Hogan is siding with the voters who sued, saying partisan gerrymandering results “in real and concrete harms to our democratic republic.” Hogan has proposed a nonpartisan redistricting commission.

Over the past 16 months, courts struck down political districting plans drawn by Republicans in North Carolina, Pennsylvania and Wisconsin. Federal judges threw out a state legislative map in Wisconsin and a congressional plan in North Carolina. In Pennsylvania, the state Supreme Court invalidated the state’s congressional districts and replaced them with a court-drawn plan.

The Supreme Court has put the drawing of new maps on hold in North Carolina and Wisconsin, but refused to block the Pennsylvania court’s adoption of revised congressional districts for this year’s elections.

K- Fed May Have to Take Britney to Court for Increased Child Support

Britney Spears’ ex-husband Kevin Federline is prepared to take his request for more child support money to court, Us Weekly can exclusively confirm.

A source close to the insider tells Us: “Kevin truly wanted to try and settle the child support payment increase without getting the courts involved out of respect for Britney, and of course, their two sons.” The insider adds this likely won’t be “resolved without a court intervention.”

K-Fed’s request comes after Spears’ Las Vegas residency, Britney: Piece of Me, became extremely successful and grossed more than $ 137 million during the show’s four-year run, according to Billboard.

“Meeting with Jamie Spears, along with his lawyer, Mark Vincent Kaplan, Kevin laid out the reasons why he was requesting the increase for child support payments,” the source says.

Meanwhile, a source close to the 36-year-old pop superstar tells Us: “This is causing Britney a tremendous amount of stress [because] Kevin does indeed have full physical and legal custody of the boys. She just wants this resolved as quickly as possible.” But she’s not ready to give in due to worry that this could be a revolving door situation. The insider added, “The cause for concern is that Kevin is given an increase this time, what is going to stop him from coming back the next time Britney signs another big deal, wanting a piece of that?”

As previously reported, the 39-year-old former backup dancer’s attorney Mark Vincent Kaplan sent a letter to his ex-wife’s team that outlined why Federline should receive more than the $ 20,000 monthly payment he gets now. The monetary compensation would be to “recognize the sacrifices he has made because he has gone above and beyond what most people would do in this situation,” a source told Us Weekly in February.

The couple — who wed in 2004 and divorced in 2007 — are parents of sons Preston, 12, and Jayden, 11. The “Toxic” singer lost sole physical and legal custody the boys in 2008 after a much-publicized breakdown, which left her placed under the care of her father, Jamie, as conservator.

WNBA Players Transition from the Court to the Corporate Office

Even after players retire from the league, the NBA stays connected with many to help them transition into life after basketball. Two years ago, they created the Basketball Associates Program, a formal training experience that prepares athletes for opportunities in management positions. Last year, three players from both the NBA and the WNBA successfully completed the program and are now working at different teams and parts of the business.

One of the former WNBA players is Stacey Lovelace, who before coming to the program was coaching at a Division I college in Michigan. She heard about the initiative through Renee Brown, former vice president of the WNBA, and now a player development specialist with the NBA’s G-League.

In the Fall of 2017, four players began their assignment at the league offices, where they are continuing to be immersed in the programs’ pillars of focus: Business Acumen, Front Office Competencies, and League Operations. One of the current associates is Lindsey Harding, the No. 1 overall selection for the 2007 NBA Draft and former WNBA All-Star, who recently retired from the WNBA after 10 years.

Black Enterprise contributor Mia Hall had the opportunity to speak with Lovelace and Harding, about their experiences managing the business side of the sport.

 

Hall: What type of impact did the Basketball Associates Program have on you as a former professional athlete?

Stacey Lovelace: It opens up a new network for you as a former player, but also it’s an opportunity for you to grow from a business standpoint and evaluate your talent and skills in a different way that is more specific to athletes from this generation.

 

We did everything from LinkedIn training to going deeper into the Collective Bargaining Agreement (CBA). Because the program is yearlong and is run by a former player, it touches on many things we need in order for us to improve our value to a business or in whatever we choose to go into following our playing careers.

 

What is the biggest lesson you learned or takeaway you received from being in the program?

 

Lindsey Harding: I think that transitioning is the hardest thing that you can do, from being an athlete and as people say ‘going into the real world.’ I’ve been playing since I was 12 so that was what my mindset was on. This program so far is teaching me to take all the lessons, my experience and everything I’ve learned from over 20 years of playing the game and being able to translate it to the work world now.

 

It’s amazing that so much does translate and that’s something, personally, that I’m working on every day in regards to teamwork, leadership, and communications. We’re also going through the CBA and different departments and seeing how it all works, things you never get to do when you play. I’m learning a lot but this is what stands out.

 

Lovelace: I learned what my passion is. After you retire from basketball, every person has a different transition and mines wasn’t the easiest. It was just a lot of trying to figure it out and it was frustrating because I knew I could do certain things and had certain skills that I didn’t necessarily have on my résumé because I haven’t done it professionally.

 

Being in the program helped me learned that my passion is helping people and telling my story. I enjoy being that connection for people to be able to say ‘look I need help’ and I’ll have an answer for them or at least be able to point them in the right direction.

 

What surprised you the most about the business side of basketball that you want to learn more about?

 

Harding: The CBA and the salary cap. I understand that a lot of lawyers come here and they take years to master it, but I want to get a really good understanding of it. I also know that I miss being part of a team and that in the future I want to work with a front office. Having this background of learning the salary cap is really gonna help me to get there.

 

What’s next for you?

 

Lovelace: I’m extremely excited about where I am right now. There’s so much room to grow in the G-League player development because the league is growing yearly and my responsibilities will continue to grow as I’m in it.

Right now, I just really want to focus on what I’m doing and impact these players lives as much as I can, helping them in every aspect of their career.

Court Clerk Fired After Asking Meek Mill For Money

The Philadelphia court clerk who reportedly slipped Meek Mill a note during his last probation violation hearing asking for money to help pay her son’s college tuition is now out of a job.

According to TMZ, Wanda Chavarria has been fired for her brazen act, ending a near three-decade career in the Philadelphia court system.

In the alleged note obtained by TMZ, Chavarria pleads, “This will probably be my son’s last semester at VCU if the tuition isn’t paid for the year and unfortunately with my bad credit, I am unable to secure a loan or co-sign a loan for my son. Anything that you can do is very much appreciated.”

The clerk said Judge Brinkley — who sentenced the rapper to two to four years in prison — was not aware of the exchange.

“The Philadelphia courts have always prioritized fairness, impartiality, and the highest ethical standards,” Gabriel Roberts told Philly.com. “The courts fully expect all employees to conduct themselves in a principled and professional manner so as not to infringe upon the neutrality of the courtroom.”

While Meek may not have donated money to Chavarria, he did give $ 10,000 to Colin Kaepernick’s #10For10 challenge.

“When I mentioned this opportunity, (Meek) immediately wanted to be involved,” Kaepernick explained in a video detailing Meek’s generosity. Kaepernick  says Mill’s donation to the Youth Services, Inc. – an organization that works with at-risk teens, children, and their families – comes from the rapper’s desire “to help uplift our communities so he matched my $ 10,000 for a total of $ 20,000.

‘You Are Nothing.’ Olympian Aly Raisman Confronts Larry Nassar in Court With Powerful Speech

Defiant and confident, Olympic gymnast Aly Raisman read a strong statement confronting Larry Nassar, who she says sexually abused her for years while she trained on the U.S. national team.

“Larry, you do realize now that we, this group of women you so heartlessly abused over such a long period of time, are now a force and you are nothing. The tables have turned, Larry,” the six-time Olympic medalist said in a Michigan court Friday. “We have our voices, and we are not going anywhere.”

Raisman was one of dozens of women who made victim impact statements at the sentencing hearing of Nassar, who pleaded guilty to multiple counts of first degree criminal sexual assault in state court.

Raisman, who revealed she had been sexually abused by Nassar in November, has also been publicly critical of USA Gymnastics and the United States Olympic Committee for failing to protect gymnasts from Nassar. “They have been quick to capitalize on my success. But did they reach out when I came forward? No,” she said Friday while giving her statement.

She looked directly at Nassar when she delivered her message to him.

You are so sick I can’t even comprehend how angry I feel when I think of you. You lied to me and manipulated me to think that when you treated me, you were closing your eyes because you had been working hard when you were really touching me, an innocent child, to pleasure yourself.

Imagine feeling like you have no power and no voice. Well you know what, Larry? I have both power and voice and I am only beginning to just use them.

All these brave women have power and we will use our voices to make sure you get what you deserve — a life of suffering spent replaying the words delivered by this powerful army of survivors.

Earlier in the day, Raisman’s 2012 Olympic teammate Jordyn Wieber revealed that she was also abused by Nassar. She is the fourth member, along with Raisman, Gabby Douglas and McKayla Maroney, of the Fierce Five to accuse Nassar of sexual abuse.

Nassar was sentenced to 60 years in prison on federal child pornography charges and could face a life sentence in state court. He will be sentenced on additional sexual assault charges in another Michigan court at the end of the month.

‘Little Girls Don’t Stay Little Forever.’ Sexual Abuse Victim Confronts Larry Nassar in Court

(LANSING, Mich.) — One after one, gymnasts and other victims of a disgraced former sports doctor stepped forward in a Michigan courtroom Tuesday to recount the sexual abuse and emotional trauma Larry Nassar inflicted on them as children — one with the warning that “little girls don’t stay little forever.”

Nearly 100 women and girls planned to speak or have their statements read during an extraordinary four-day sentencing hearing. Many of them cried as they gave the initial testimonies Tuesday. Some requested that their identities not be made public. The judge consoled the victims and said they should not blame themselves.

“I testified to let the world know that you are a repulsive liar,” one victim, Kyle Stephens, said to the 54-year-old Nassar who bowed his head with his eyes closed or looked away as she and others spoke. Stephens, the first to speak, said Nassar repeatedly abused her from age 6 until age 12 during family visits to his home in Holt, near Lansing. She said he rubbed his genitals on her and digitally penetrated her, among other things. She said Nassar later denied it, and her parents believed him.

“Perhaps you have figured it out by now, but little girls don’t stay little forever,” Stephens said. “They grow into strong women that … destroy your world.”

Nassar has pleaded guilty to molesting females with his hands at his Michigan State University office, his home and a Lansing-area gymnastics club. He also worked for Indianapolis-based USA Gymnastics, which trains Olympians.

Another statement came from Donna Markham, who told of how her daughter Chelsey killed herself in 2009, years after Nassar sexually abused her during a medical examination.

“It all started with him,” she said, describing her daughter’s downward spiral into drug abuse.

Victims described experiencing “searing pain” during the assaults and having feelings of shame and embarrassment. They said it had changed their life trajectories — affecting relationships, causing them to be distrustful and leading to depression, suicidal thoughts and anger and anxiety on whether they should have spoken up sooner.

“He touched the most innocent places on my body,” said 17-year-old Jessica Thomashaw, recounting how she was sexually assaulted at ages 9 and 12. “I couldn’t be just a normal girl anymore, and I forever lost a big piece of my childhood due to his abuse.”

Ingham County Circuit Judge Rosemarie Aquilina, who is expected to order a sentence Friday, said the system had failed them.

“You shouldn’t be angry with yourself,” she told a 31-year-old victim, who said she was assaulted almost 20 years ago. “You went to him for pain and healing, and you didn’t know. No one faults you or any other victim for that. You were a child.”

The Michigan attorney general’s office is seeking 40 to 125 years in prison for the 54-year-old Nassar. The maximum represents a year for each of the 125 girls and women who filed reports of abuse with campus police. He already has been sentenced to 60 years in federal prison for child pornography crimes.

Olympic gold medalist Simone Biles on Monday said she was among the athletes sexually abused by Nassar. Another gold medalist, Aly Raisman, tweeted Monday that she would not attend the sentencing “because it is too traumatic for me. My impact letter will be read in court in front of Nassar. I support the brave survivors. We are all in this together.”

Olympians McKayla Maroney and Gabby Douglas also have said they were among Nassar’s victims as teens.

In November, he admitted to digitally penetrating 10 girls, mostly under the guise of treatment, between 1998 and 2015. As part of plea deals in two adjacent Michigan counties, he said his conduct had no legitimate medical purpose and that he did not have the girls’ consent.

Nassar is scheduled to be sentenced in Eaton County in two weeks.

Rapper Nas is reportedly fed up with his unofficial visitation arrangement with ex-wife and singer, KelisThe Blast reports.

In court documents obtained by the site, Nas has tried to “work cooperatively with Kelis over the years,” but Kelis only “allows him to exercise his custody with their son when she deems it convenient for her.”

The documents allege the visitation schedule is so sporadic that Kelis has refused “to set up time for [their] son and [Nas]  to spend time together,” for months at a time.

A preliminary plan reportedly put together by Nas and his legal team asks for the Queen’s lyricist to spend time with their son, Knight Jones, on the first, third and fifth weekend of every month.

He also asked that their son spend Mother’s Day with Kelis, Father’s Day with him, and they both get their son on their respective birthdays.

Knight is the pair’s only son. They divorced after 5 years of marriage in 2010.

Say What Now? Convicted Sex Offender Attacked in Court By Another Prisoner After Pleading Guilty to Sexually Assaulting a 4-Year-Old [Video]

A fellow prisoner took punishment into his own hands when he attacked a man in court who had just pleaded guilty to sexually assaulting a 4-year-old girl.

Christopher Elwell, 29, was in court Thursday on charges that he assaulted the child during a sleepover at a Dover Housing Authority property in June.

After his arrest, Elwell told officers that he was watching porn on his cell phone in a bedroom with the victim and two other children when the 4-year-old said she wanted to imitate what was in the video.

It’s not clear what his relationship is to the children.

Elwell pleaded guilty in court and was sentenced to 7 1/2 to 15 years in prison. According to WMUR, he also pleaded guilty to failing to register as a sex offender for a 2008 incident in which he pleaded guilty to sexually assaulting a 14-year-old.

As Elwell took a seat in the back of the courtroom after his sentencing, inmate Josiah Davies approached Elwell and started head-butting him.

Video shows guards pulling a shackled Davies off of Elwell.

The Stafford County Attorney’s Office told WMUR that the two prisoners did not know each other, and they believe something about Elwell’s case set Davies off.

Davies, who was arrested for forgery and violation of probation, was in court Thursday for a dispositional hearing. It was pushed back to Dec. 4 after the fight.

He’s currently being held on a $ 100,000 cash bond. Elwell will not be allowed to have unsupervised contact with juveniles after he’s released from prison.

Appeals Court Tosses Two More Would Be Heirs To Prince Estate

The Minnesota Court of Appeals has ruled that two descendants of a former security chief at Paisley Park who Prince reportedly regarded as a brother are not entitled to any part of the Purple One’s estate.

A three-judge panel on Monday said a lower court ruled correctly when it excluded Brianna Nelson and her niece, Victoria Nelson, as heirs, according to Page Six. They’re the daughter and granddaughter, respectively, of the late Duane Nelson Sr.

While they’ve acknowledged Duane was not a biological relative of Prince, who died without a will, they claimed Prince’s father raised Duane as his son anyway.

The Minnesota Supreme Court rejected five other would-be Prince heirs last week. Darcell Gresham Johnston, Loya Janel Wilson, Loyal James Gresham III, Orrine Gresham and Venita Jackson Leverette had all claimed that Nelson wasn’t really Prince’s father. They claimed they were Prince’s half-siblings through other men.

The five were not allowed to undergo genetic testing to try to prove it. Carver County District Judge Kevin Eide ruled earlier that John L. Nelson and Mattie Shaw were legally presumed to be Prince’s parents since they were married when he was born.

The appeals panel used the Supreme Court’s analysis of Minnesota parentage law in finding that Brianna and Victoria Nelson are not entitled to inherit from Prince’s estate either.

A Washington, D.C. court order issued Thursday compels DreamHost to hand the Department of Justice information about the people behind DisruptJ20.org. U.S. court upends murder conviction of Blackwater contractor

WASHINGTON — A federal appeals court on Friday overturned the first-degree murder conviction of a former Blackwater security contractor, ordering a new trial for the man prosecutors say fired the first shots in the 2007 slayings of 14 Iraqi civilians at a crowded traffic circle in Baghdad.

In a split opinion, the three-judge panel of the U.S. Court of Appeals of the District of Columbia Circuit ruled a lower court erred by not allowing Nicholas Slatten to be tried separately from his three co-defendants in 2014. The 33-year-old contractor from Tennessee is serving a life sentence for his role in the killings, which strained international relations and drew intense scrutiny of the role of American contractors in the Iraq War.

The court also ordered new sentences for the three other contractors, Paul Slough, Evan Liberty and Dustin Herd. They were each found guilty of manslaughter and firearms charges carrying mandatory 30-year terms.

The judges determined those sentences violated the constitutional prohibition of cruel and unusual punishment because prosecutors charged them with using military firearms while committing another felony. That statute, typically employed against gang members or bank robbers, had never before been used against overseas security contractors working for the U.S. government.

The lawyers for the defendants could not immediately be reached for comment.

At the weekslong trial held in 2014, federal prosecutors and defense lawyer presented very different versions of what triggered the September 2007 massacre in Nisour Square.

The government described the killings as a one-sided ambush of unarmed civilians, while the defense said the guards opened fire only after a white Kia sedan seen as a potential suicide car bomb began moving quickly toward their convoy. After the shooting stopped, no evidence of a bomb found.

In issuing their ruling benefiting the defendants, the judges said they were in no way excusing the horror of events they said “defies civilized description.”

“In reaching this conclusion, we by no means intend to minimize the carnage attributable to Slough, Heard and Liberty’s actions,” said U.S. Circuit Judge Karen L. Henderson, writing for the court. “Their poor judgments resulted in the deaths of many innocent people.”

Actress Keshia Knight Pulliam will appear at court in Norristown, Pennsylvania, Monday with her former TV dad Bill Cosby when he goes on trial for allegedly drugging and sexually assaulting former Temple University employee Andrea Constand, Cosby’s spokesman tells PEOPLE.

Pulliam, 38, played Cosby’s daughter Rudy on The Cosby Show.

And she’s not the only person who will be appearing at court.

Actress Phylicia Rashad, 68, who played his wife on The Cosby Show, will make an appearance at some point during the trial as well, Wyatt says.

Representatives for Pulliam, Rashad and Taylor could not immediately be reached for comment about their attendance at the trial.

Johnny Taylor, president of the Thurgood Marshall College Fund, will also appear at the courthouse with Cosby and Pulliam, says Andrew Wyatt, Cosby’s spokesman.

“Johnny feels Mr. Cosby has done so much for historically black colleges over his career and it’s important for him to show that support and say ‘Thank you’  because he has not been found guilty of anything,” Wyatt tells PEOPLE. “They’re coming in to hear the truth. Keshia feels the same way. She’s not here to proclaim guilt or innocence. She’s here to finally hear the truth for herself in the courtroom. She wants people to stop listening to the sensationalism and come hear the truth.”

Pulliam and Rashad have made public comments supporting the veteran comedian.

“I can only speak to the great man that I know and love, who has been so generous, who has been such a philanthropist, giving back millions of dollars to education and schools,” Pulliam told Access Hollywood Live in January 2015.

Cosby, 79, goes on trial Monday for allegedly drugging and sexually assaulting former Temple employee Andrea Constand in January 2004. He has pleaded not guilty and denies similar allegations from more than 60 women. The trial is expected to last two weeks.

The Cosby Show aired from 1984 to 1992 on NBC and was one of the biggest TV hits of the 1980s.

Bobby Flay Cheated With January Jones, Claims Estranged Wife In Court Docs

Bobby Flay and Stephanie March’s divorce is not what you’d call amicable.

The couple split in early April after 10 years of marriage and March is challenging the prenup under which Flay is required to pay the actress $ 5,000 a month.

In Touch reports that March is challenging the prenup on the grounds that Flay allegedly cheated on her with three women, including actress January Jones.

A source familiar with the case told the magazine that the former “Law & Order: SVU” actress is claiming in court papers that the 50-year-old celebrity chef “committed adultery” with Jones several times in the in early 2010. The magazine also reports that March has accused Flay of cheating with a food stylist and his assistant.

Page Six previously reported that it’s believed the couple’s prenup had no infidelity clause, and if true, March’s claims likely would not help her cause. However, TMZ reported that the actress also filed documents claiming that it’s her “amazing palate” that is responsible for his success.

Reps for Flay and Jones have yet to respond to requests for comment.
