Prosecutor Asks For Review Of How Smollett Case Was Handled

(AP Photo)

CHICAGO (AP) — A state’s attorney in Chicago has asked the county’s inspector general to review how her office handled “Empire” actor Jussie Smollett’s criminal case.

Cook County State’s Attorney Kim Foxx said in a statement Friday that she pledges her “full cooperation” and welcomes the investigation from Inspector General Patrick Blanchard. Foxx says “ensuring that I and my office have the community’s trust and confidence is paramount to me.”

The Chicago Tribune reports that Blanchard wrote a letter Thursday informing Cook County Board President Toni Preckwinkle and other county leaders about Foxx’s request.

Chicago Mayor Rahm Emanuel and others have criticized the decision by Foxx’s office to drop charges against Smollett accusing him of filing a false report to police that he was the victim of a racist, anti-gay attack in January.

Did he take it easy on all those alleged victims? Exactly.

Michael Irvin Posts Photo From Hospital, Asks For Prayers

Former Dallas Cowboys wide receiver Michael Irvin posted a photo of himself in a hospital bed on Instagram Tuesday, saying he is worried he may have throat cancer and has been undergoing tests for the disease.

Irvin reveled in the post that his father died from throat cancer at 51, and after having persistent throat issues for two months, he decided to get tested.

The post says:

“Spent Sun & Mon in LA at UCLA medical Health (Ronald Reagan Hospital) doing health test. I would not usually do this but this I need to share. Growing up in the ghetto of Ft Lauderdale the one thing you have to conquer to get out is FEAR. I did! As a football player the no fear gift served me well as a blessing and an asset on the field but sometimes off the field it’s been a curse and a liability. This past football season after the @dallascowboys beat the @Saints i was so elated and hyped I lost my voice and the problem persisted for almost 2months. After visiting some of the best throat Doctors they thought it to be wise to take a deeper look at the situation. So we schedule and performed a throat biopsy. To give background I share with you that I lost my father at the young age of 51. He had throat cancer. This daemon has chased and vexed me deep in my spirit all my life. So saying I am afraid this time is a big big understatement. I AM TERRIFIED!! My Faith tells me whenever you face great fear you go to your greatness power. Mine is God. I am asking all who will. Could you please send up a prayer to help my family and I deal with whatever the results may be? Thanks for your thoughts and prayers in advance🙏🏾🙏🏾I will continue to pray for your fams protection and prosperity as well. May God Bless us all 🙏🏾🙏🏾”‬

Trump Administration Changes Course, Asks Court To Strike Down ACA

In a dramatic move that will have implications for the coming 2020 election, the Trump administration Monday night reversed its previous position and asked a federal appeals court to strike down the entire the Affordable Care Act.

The Justice Department said it now agrees with the plaintiffs in a lawsuit challenging the law — a group of Republican attorneys general and governors.

In December, U.S. District Judge Reed O’Connor in Fort Worth, Texas, agreed with the GOP plaintiffs, saying that because the 2017 tax law passed by Congress eliminated the tax penalty for not having health insurance coverage, the rest of the health law is now unconstitutional.

A group of Democratic attorneys general, led by California’s Xavier Becerra, appealed that ruling to the 5th Circuit Court of Appeals. The law remains in place while the case proceeds.

The Trump administration originally declined to accept the plaintiffs’ argument. Instead, officials argued that since the tax was now gone, the provisions of the law requiring insurance companies to sell to people with preexisting conditions and not charge them more should fall.

Now that position has changed.

“The Department of Justice has determined that the district court’s judgment should be affirmed,” said a terse letter from Assistant Attorney General Joseph “Jody” Hunt to the appeals court handling the case. That means the administration is now formally supporting elimination of the entire ACA.

The Department of Health and Human Services declined to comment on the change and referred all questions to the Justice Department.

President Donald Trump has repeatedly called for the law to be repealed and replaced, but when Republicans controlled Congress they could not muster the necessary votes. Just last week, he lashed out at the late Sen. John McCain (R-Ariz.) for failing to support that effort.

The government’s court filing came on the same day federal officials announced that more than 11 million people used the insurance marketplaces set up by the law to purchase policies this year. The Justice Department move also occurred hours before House Democrats were scheduled to unveil their proposal to shore up the health law — setting up another battle line for the 2020 contests.

But Democrats on Monday night were quick to challenge the latest action.

“While the Trump Administration broadens its monstrous ambitions from destroying protections for pre-existing conditions to tearing down every last benefit and protection the Affordable Care Act provides, Democrats are fiercely defending the law of the land and protecting all Americans’ health care,” said a statement from House Speaker Nancy Pelosi.

Senate Minority Leader Chuck Schumer blasted the move in comments on the Senate floor Tuesday morning. “In two short sentences, the Trump administration crystallized its position that the health care coverage enjoyed by nearly 20 million people, as well as the protections by tens of millions more with preexisting conditions, should be annihilated,” he said.

Lawyers who have been following the case call the administration’s actions more than unusual.

“Much as it may dislike the fact, the Trump administration has an obligation to defend acts of Congress,” wrote Nicholas Bagley, a University of Michigan law professor and a former Justice Department attorney, in a blog post.

Invalidating the ACA could also have enormous effects on the entire health system. It would end not only the health exchanges, but also the expansion of the Medicaid program, numerous changes to Medicare and protections for people with employer-provided coverage.

“The act is now part of the plumbing of the health care system,” Bagley wrote. “Which means the Trump administration has now committed itself to a legal position that would inflict untold damage on the American public.”

Major League Baseball Asks for Its $5,000 Campaign Donation Back From Sen. Cindy Hyde-Smith

When lobbyists for Major League Baseball made a donation in connection with a political event on Friday, they probably didn’t expect to ask for it back two days later.

Amid outcry over racially insensitive remarks made by Mississippi Sen. Cindy Hyde-Smith earlier this month, the MLB has asked her campaign to return its $ 5,000 donation.

On a Nov. 2 campaign stop, Sen. Hyde-Smith was captured in a viral video making remarks about attending a “public hanging.”

“If he invited me to a public hanging, I’d be in the front row,” Sen. Hyde-Smith said, referring to a supporter. Her opponent in Tuesday’s run-off election, former Democratic Representative Mike Espy, is an African-American.

Hyde-Smith subsequently gave a partial apology during a Nov. 20 debate against Espy.

“For anyone that was offended by my comments, I certainly apologize,” she said. “There was no ill will, no intent whatsoever in my statements.”

She then noted “this comment was twisted and it was turned into a weapon to be used against me.”

The MLB made its contribution to her campaign weeks after the senator made those comments.

“The contribution was made in connection with an event that MLB lobbyists were asked to attend,” the league said in a statement issued Sunday, reported the Daily Beast. “MLB has requested that the contribution be returned.”

Several companies, including Walmart, have recently asked her campaign to return donations following the comment, reported USA Today.

It’s not the first controversy that Hyde-Smith has caused.

In 2014, she posted a picture on her Facebook page showing her posing at the Jefferson Davis homestead holding a rifle and wearing a Confederate hat, reported the Washington Post.

“Mississippi history at its best!” she wrote.

Hyde-Smith has also been caught on video making jokes about voter suppression.
