For California Attorney General Xavier Becerra, Resistance Is Personal

When President Donald Trump demands a border wall or threatens to deport young unauthorized immigrants, one of the loudest opposition voices comes from the son of Mexican immigrants — who also happens to be California’s top lawyer.

Democrat Xavier Becerra, the state’s first Latino attorney general, is not only one of Trump’s biggest critics, he is an unrelenting adversary in court, striking at Republican efforts to overturn federal rules not just on immigration, but on health care, birth control, climate change and more.

On Tuesday, Becerra, 61, will take the national stage when he gives the Spanish-language rebuttal to the president’s State of the Union address. He has challenged the Trump agenda before.

Becerra has taken the Trump administration to court 45 times since former Gov. Jerry Brown appointed him to the job in 2017. In November, voters overwhelmingly gave him a four-year term, validating his decision to leave Congress after 24 years.

Becerra, whose wife is a doctor, is leading a coalition of 20 states and the District of Columbia in defending the Affordable Care Act against a Texas lawsuit that could determine the fate of the law — and with it, health coverage for millions of Americans. And he won a nationwide court injunction last year that blocked the Trump administration’s decision to end the Deferred Action for Childhood Arrivals (DACA) program, which allows qualified young people who were brought into the U.S. illegally as children to obtain temporary work permits.

When news reports last month revealed that Trump was considering diverting emergency disaster relief funds from California, Florida and Texas during the partial federal government shutdown, Becerra condemned the president on Twitter for poaching funds for a “reckless & lawless” border wall.

The fights are ones that Becerra describes as personal. He talked to California Healthline’s Samantha Young about his role — and how his upbringing influences his legal decisions.

The following interview has been edited for length and clarity.

Q: You were a veteran member of Congress in a leadership role. Why did you take this job?

November 2016 hits. We have the election. All the things that I cared about were going to be placed in jeopardy by this new president.

I found myself thinking I probably could make a bigger difference as the attorney general for the entire state of California, defending everything I fought to erect, than as a minority member in the House of Representatives trying to make my point, but always losing.

I made a calculation. I think I made the right choice.

Q: You have sued the Trump administration 45 times on education, immigration, health care, birth control access, climate change and more. What’s the one case you really wanted to win?

I’ll give you two.

First, the Affordable Care Act, knowing how much it has been a game changer for families. I would never have believed that I’d be leading the effort to protect the entire Affordable Care Act as an attorney general for one of 50 states. But here I am.

The second one is the DACA litigation, because as the son of immigrants, I watched my parents struggle and saw the things they had to live through. I believe these DACA recipients are going to be some of the greatest leaders America has and it’s because they had to go through so much like my parents did. So, it’s very personal.

Q: Do you remember your parents’ economic struggles as a child?

I thought I was middle class growing up as a kid. It really wasn’t until I was driving with my mom to start my first day at Stanford University, driving through Palo Alto, that I realized I’m not middle class.

We always had decent food to eat. I never got a pair of Converse. I never had a pair of Levi’s jeans. Never had that kind of stuff, but I always had clothes. It didn’t dawn on me that we were much different than other folks.

Q: How does your upbringing influence your decisions as attorney general?

Everything I do is informed by what I grew up with. I defend immigrants with a passion because I saw immigrants every day of my life. And I know how hard they work. I never saw a day where my dad didn’t work.

My mom came here when she was 18 from Guadalajara, when she married my dad. Didn’t know English. Learned it. She could always find a job, and when she learned English it became easier. But she could never go very high because she never went to college.

So, when someone wants to knock an immigrant, you’re knocking my dad and my mom.

Q: You believe everyone should have access to health care. Was there ever a period in your life when you didn’t have health insurance?

I don’t ever recall a time when I didn’t. That’s why I’m such a big defender of unions. My dad was a construction worker. My dad got to the sixth grade. As difficult as it is for someone with a sixth-grade education to get a decent job, and while being a manual laborer and working construction doesn’t make you a millionaire, if you work for a union it gets you basic benefits.

I knew what it meant to have health insurance, especially on the day my mom ended up having a miscarriage. She was hemorrhaging at home and she had to be rushed to the hospital. There was no hesitation.

We knew we could go to the doctor — and everybody should know that. For me, health care is a right. I’ve been a single-payer advocate all my life.

Q: Why do you think it’s important to build coalitions with other states when challenging the Trump administration?

Lifting something by yourself is very difficult. When you get a team to do it, it just clicks so much easier. Maybe it’s because I went through Congress more years in the minority than the majority, where you realize what it takes to actually cobble together a coalition to get something done. Or, maybe it’s just that when you’ve been in a minority all your life, the son of immigrants with very little, you know it takes a team effort.

I got through Stanford knowing my family didn’t have a lot of money, so I had to work, take out student loans and receive help from the government. It was a combination of a lot of things.

Q: What’s your response to critics who say state attorneys general are “militarizing” their office to overturn policies your party can’t block in Congress?

Which of the cases should we not have filed? The one to defend the Affordable Care Act, or the one to prevent women from losing access to birth control, or is it the one to allow DACA Dreamers to be deported, or is it the one to make sure that we are defending against a crazy border wall, or is it the one that should allow predatory for-profit colleges to continue to avoid having to provide relief to students who were defrauded?

We’re not doing this because we’re trying to attack the federal government or because we’ve got it out for this particular president. How would we explain to the people who would have been unprotected why we just watched, why we just spectated?

Storing Your Power of Attorney in a Safety Deposit Box

Storing your estate documents, such as a Power of Attorney, in
a secure place is extremely important. Some of us assume that one of the safest
places to store our documents, in particular our Power of Attorney, is at a
bank in a safety deposit box.

However, because a Power of Attorney is a document people
use to allow a trusted friend to make decisions when they are unable to,
storing your document (or at least your only copy) with a bank is often not
recommended.

In this post, discover a couple of reasons why you shouldn’t store your Power of Attorney in a safety deposit box and what you should do instead.

What is a POA?

A Power of Attorney, sometimes called a POA, lets you provide someone else (like a friend or family member) with the authority to make important decisions (such as financial or business decisions) for you when you’re unable to. If you’re creating a Power of Attorney, then you’re the principal and whoever you appoint to make your decisions is your attorney-in-fact, sometimes called an agent.

A person can have an Ordinary Power of Attorney, meaning the
principal is still capable of making their own decisions but can’t for reasons
such as long-term travel, or an Enduring Power of Attorney, meaning the
principal is unable to make their own decisions for reasons like they’ve become
incapacitated due to an illness or disability.

To use a POA, an attorney-in-fact often needs to have the original
document that was created and signed by the principal, which is why where it is
stored is so important and why you should avoid storing it in a safety deposit
box.

Be Sure You Can Access Your POA When You Need It

Keeping your original Power of Attorney in a safety deposit box might mean it’s not able to be accessed when it’s needed most.

Imagine a friend creates an Enduring Power of Attorney and appoints
you as the attorney-in-fact. Your friend then places their original POA in
their safety deposit box and doesn’t create any certified copies to place
anywhere else. Often, deposit boxes can only be opened during banking hours,
which means you’ll be unable to access it after hours, on weekends, or on
holidays.

If something were to happen, like a car accident that
results in your friend being incapacitated, and the Enduring Power of Attorney is
in a deposit box, you may not be able to obtain the Power of Attorney to make important,
possibly time-sensitive decisions, such as authorizing payment for medical
bills or providing funds to help family members fly to see their loved one.

Be Sure You Don’t Need a POA to Access One

Similarly, a Power of Attorney is often required by banks to
allow someone like an attorney-in-fact to open a person’s safety deposit box.
So, without one, you may be unable to access the document and start your duties
as an attorney-in-fact.

In this situation, it is easy to see how big of a problem it
would be if the very document you need to enter the deposit box is inside it.

Where Should You Store Your POA?

Although a deposit box is a great place to store important
documents, it is not a good place to store your only POA. That said, it can
still be used to store a copy of your document as long as another copy is
available elsewhere in case the bank or deposit box is inaccessible when you
need access. You can also store your POA with someone you trust, like your
lawyer, accountant, or attorney-in-fact or even in a safe in your home.

Wherever you decide to store your document, ensure that your
attorney-in-fact will be able to access the document when it’s needed.

Storing Your Power of Attorney

A person should put a lot of thought about where they store
important estate documents such as a Power of Attorney. You might think a
safety deposit box at a bank is a great place to store your POA, but it might
not be accessible by your attorney-in-fact when it is needed the most.

Therefore, it’s better to store multiple copies of your
document in a few places or store it with a trusted person or in a safe
location in your home.

Franklin Attorney: $3 Million In Back Taxes Paid To IRS

DETROIT (AP) — Aretha Franklin‘s estate has paid at least $ 3 million in back taxes to the IRS since her death in August, an attorney for the late Queen of Soul’s estate said Thursday.

The estate is being audited by the IRS, which filed a claim this month in a county probate court north of Detroit, David Bennett told The Associated Press.

Earlier Thursday, TMZ reported that legal documents it obtained showed the IRS claimed the singer owes more than $ 6.3 million in back taxes from 2012 to 2018 and $ 1.5 million in penalties.

“We have a tax attorney. All of her returns have been filed,” Bennett told the AP. “We have disputes with the IRS regarding what they claim was income. We claim its double-dipping income because they don’t understand how the business works.”

He added that Franklin had a lot of expenses whenever she toured.

“She had to pay for transportation, hotel rooms, backup singers, musicians. When she did that the IRS was questioning the returns she filed,” Bennett said. “We’re going through audits. Returns were filed as timely as we could get them filed.”

Franklin died of pancreatic cancer in August in her Detroit apartment. She was 76.

At the time of her death, Franklin owned a home in Oakland County’s Bloomfield Township. The IRS filed the claim this month in Oakland County Probate Court in Pontiac.

Documents filed in an Oakland County court after Franklin’s death did not mention the value of her estate , which could run into the tens of millions.

Franklin’s estate also has paid money to the state of Michigan and other jurisdictions “where she would have had some income,” Bennett said.

Franklin had been the target of a number of lawsuits by creditors during the late 1980s and 1990s.

In 2008, the singer said an attorney’s mistake caused her $ 700,000 mansion in Detroit to slip into foreclosure over $ 445 in 2005 taxes and late fees. The Detroit Free Press reported then that Franklin owed a total of $ 19,192 in back taxes on the property through 2007.

Letitia James First Black New York Attorney General is Coming For Trump’s Neck — And His Family

Michael Cohen won’t be the only Trump associate serving time in the pen for breaking the law if it’s up to Letitia James. The incoming New York Attorney General revealed that she plans to ignite a fire under President Donald Trump and anyone in his camp who may have engaged in illegal activity within her jurisdiction once she steps into her new role next month.

“We will use every area of the law to investigate President Trump and his business transactions and that of his family as well,” she said in an exclusive interview with NBC News. James, who currently serves as New York City’s Public Advocate, became the first African American and the first woman to be elected as attorney general in New York, making her one of many African Americans who scored a historic win during the 2018 Midterm Election. “We want to investigate anyone in his orbit who has, in fact, violated the law,” she added.

The former New York City Councilwoman went on to outline the following probes she intends to pursue regarding the president’s namesake business, the Trump Organization, his campaign headquarters, and the Trump Tower — all of which are based in New York.

  • Any illegalities involving Trump’s real estate holdings in New York, highlighting the October New York Times investigation into the president’s finances.
  • The June 2016 Trump Tower meeting with a Russian official.
  • Examine government subsidies Trump received, which were also the subjectof Times investigative work.
  • Whether he is in violation of the emoluments clause in the U.S. Constitution through his New York businesses.
  • Continue to probe the Trump Foundation.

James is also working on passing a bill that would change New York’s double jeopardy laws so that she could potentially indict someone who allegedly violates New York state law even if they are granted a presidential pardon over federal charges or convictions.

“I think within the first 100 days this bill will be passed,” she said, adding, “It is a priority because I have concerns with respect to the possibility that this administration might pardon some individuals who might face some criminal charges, but I do not want them to be immune from state charges.”

She added, “taking on President Trump and looking at all of the violations of law I think is no match to what I have seen in my lifetime.”

James is not the only black woman in office itching to light a fire under Trump. Rep. Maxine Waters, who has led the charge to impeach Trump, is poised to take over the House Financial Services Committee, which would give her the power to subpoena the president. As chair of the powerful banking panel, Waters could target Deutsche Bank for its past dealings with Trump and issue subpoenas to Trump allies, like Treasury Secretary Steven Mnuchin, forcing him to provide documentation regarding the president’s alleged ties to Russia.

Rep. Kamala Harris is another woman who could give Trump a run for his money should she decide to jump into the 2020 presidential race. She told The Hill that she intends to make a decision about whether to run for president in 2020 over the holidays, adding that it will “ultimately be a family decision.”

MoviePass‘ parent company Helios and Matheson is under legal probe due to a shareholder lawsuit. A source told CNBC the company will be investigated by the New York Attorney General with regard to information disclosed to investors. 

“We are aware of the New York Attorney General’s inquiry and are fully cooperating,” Helios and Matheson said in a statement. “We believe our public disclosures have been complete, timely and truthful and we have not misled investors.
