Kevin Spacey Makes Surprise Court Appearance for Hearing in Groping Case

(NANTUCKET, Mass.) — Sporting a gray suit and glasses, Kevin Spacey appeared Monday at a Massachusetts courthouse where a judge is set to hold a hearing in the case accusing the disgraced actor of groping a young man at a Nantucket bar in 2016.

Spacey’s appearance comes somewhat as a surprise as he was not required to attend the hearing and has stayed away from the courthouse except for a brief hearing in January, which he also tried to avoid.

The 59-year-old former “House of Cards” actor, who has pleaded not guilty to a charge of indecent assault and battery, did not comment as he walked in with his lawyers. Spacey faces up to 2 ½ years in jail if convicted.

Spacey’s attorneys have stepped up their attacks on the credibility of the man who brought the allegations. In court documents filed Friday, defense attorney Alan Jackson accused the man of deleting text messages that support Spacey’s claims of innocence.

It’s the only criminal case that has been brought against the two-time Oscar winner since his career fell apart amid a flurry of sexual misconduct allegations in 2017.

The case first came to light that year when former Boston TV anchor Heather Unruh said Spacey got her son drunk and then sexually assaulted him at the Club Car, a popular restaurant and bar on the resort island off Cape Cod.

Unruh’s son told police that he wanted to get a picture with Spacey and went over to talk to him after his shift ended at the Club Car, where he worked as a busboy. The man said Spacey bought him several drinks and tried to persuade him to come home with him before unzipping the man’s pants and groping him for about three minutes.

The accuser told police that he tried to move Spacey’s hands, but the groping continued, and he didn’t know what to do because he didn’t want to get in trouble for drinking. The man said he fled when Spacey went to the bathroom.

Spacey’s lawyers have called the allegations “patently false” and accused the man of lying in the hopes of making money in a civil case against Spacey. They argued that the two engaged in nothing more than “consensual flirtation” and questioned why, according to the man’s story, he did not object or try to move away if he was being assaulted.

Spacey’s attorney urged the court in Friday’s motion to order prosecutors to hand over a “complete and unaltered” forensic copy of the accuser’s cellphone, saying newly produced evidence confirms he “deleted exculpatory text messages and provided falsified screenshots of his conversation from the night in question to law enforcement.”

Spacey’s lawyer is also seeking any communications about the case made by a top prosecutor in the Cape & Islands District Attorney’s Office who disclosed that his sister is friends with the accuser’s mother.

Judge Thomas Barrett has ordered the Club Car to hand over any surveillance footage taken between 5 p.m. July 7, 2016, and 3 a.m. July 8, 2016.

Supreme Court Declines To Hear Military Medical Malpractice Case

The family of a young Navy nurse who died after military doctors allegedly failed to halt massive bleeding following childbirth won’t get a hearing in the nation’s highest court.

The Supreme Court on Monday denied a petition that sought to change what’s known as the Feres doctrine, a long-standing rule that bars active-duty military members from suing the federal government for injuries, including medical malpractice.

The justices declined to discuss the case of Navy Lt. Rebekah “Moani” Daniel, who was 33 in 2014 when she died following a massive postpartum hemorrhage at the Naval Hospital Bremerton, within hours of the birth of her daughter, Victoria.

In court documents, Justice Ruth Bader Ginsburg said she would have granted the petition. Justice Clarence Thomas dissented from the decision, arguing that it was up to the court to reconsider the rule in the absence of a decision by Congress. He noted that the court in recent rulings “twisted traditional tort principles” to allow certain veterans to seek damages for negligence.

“Such unfortunate repercussions — denial of relief to military personnel and distortions of other areas of law to compensate — will continue to ripple through our jurisprudence as long as the Court refuses to reconsider Feres,” he wrote.

Through a lawyer, the nurse’s widower, Walter Daniel, and her daughter, Victoria, now 4, argued that the court should amend the 1950 ruling to allow service members to sue for medical malpractice the same way civilians can.

“Sadly, the justice system remains closed to our family, our colleagues and the families who commit their lives to military service,” Daniel, 39, said in a statement Monday. “Victoria and I won’t have the opportunity to learn what led to Moani’s death, and to ensure others don’t experience the same tragedy.”

Andrew Hoyal, Daniel’s lawyer, said he was “clearly disappointed” at the decision but heartened at the responses from Thomas and Ginsburg.

“We knew from the beginning that this would be a long journey with even longer odds,” he said.

Rebekah Daniel died on March 9, 2014, at the Washington state facility. In a 2015 wrongful death lawsuit, her husband claimed that she died from botched medical care that failed to halt hemorrhaging of nearly a third of the blood in her body.

Daniel, a former Coast Guard officer, disputed the findings of a Navy autopsy that concluded Rebekah Daniel died of “natural” causes possibly linked to a rare, hard-to-prove complication of childbirth.

But that lawsuit and subsequent appeals were dismissed not based on the facts of the case but because of the Feres doctrine, which holds that active-duty members of the military can’t sue under the Federal Tort Claims Act for harm that they incur “incident to service.”

The ruling was last challenged in the high court more than 30 years ago when the justices voted 5-4 to uphold it. That decision drew a scathing dissent from Justice Antonin Scalia, who declared the rule should be scrapped. More recently, Justice Thomas also argued it should be amended.

Since then, however, the court has refused to accept two previous petitions that would have allowed reconsideration. The Daniel request beat the odds. Of the 7,000 to 8,000 cases submitted to the Supreme Court each term, only about 80 are accepted.

Congress has considered amending the Feres rule in the past but stopped short of action. In April, Rep. Jackie Speier (D-Calif.) introduced H.R. 2422, which would allow active-duty service members to sue the government for damages caused by medical malpractice. The bill has been referred to the House judiciary committee.

Daniel said he would continue to work with lawmakers and advocates to change the rule.

“Our case and our fight is over — but it continues for other service members. Moani’s story has generated a groundswell of momentum to correct the injustice of Feres, and now this issue is going all the way to Capitol Hill,” the statement said.

U.S. Government Tells Fashion Label in Supreme Court Case: Stop Trying to Make ‘FUCT’ Happen

The U.S. Supreme Court held G-rated arguments over an R-rated word on Monday while debating whether “FUCT” is too scandalous to trademark.

The eight-year saga of an L.A.-based clothing line founded by artist Erik Brunetti came to Washington, D.C., as justices heard his case against the United States Patent and Trademark Office.

It started in 2011, when Brunetti’s trademark application for FUCT—which, according to CNN, stands for “Friends You Can’t Trust”—was denied on the grounds that it violated the Lanham Act. (Representatives for the brand did not respond to The Daily Beast’s request for comment.)

R. Kelly’s Lawyers Said He Missed Court Because He Can’t Read

R. Kelly recently lost a civil lawsuit against him but his lawyers claim it isn’t his fault that he did not show up. His lawyers, Zaid Abdallah and Raed Shalab, filed legal documents saying that he did not appear in court  due to his inability to read.

According to TMZ, the documentation says that the disgraced singer “suffers from a learning disability that adversely affects his ability to read … in essence he cannot.”

The Chicago crooner was due in court after being being sued by a woman named Heather Williams who claims Kelly sexually abused her when she was 16-years-old. Since Kelly did not show up to court this week, she won by default. Abdallah and Shalab are asking the judge to vacate the default decision and start the case over so Kelly can be present.

Kelly was reportedly “overwhelmed” when he was served with papers while in Cook County jail because he couldn’t understand what it said.  Williams claimed that she tried to have Kelly served at his home at the Trump Towers but the heavy security made it impossible. Kelly had been jailed after being charged with 10 counts of aggravated criminal sexual abuse for a separate case regarding unpaid child support.

After the airing of the Lifetime docu-series, Surviving R. Kelly, his life began to fall apart. Not too long after it aired he was charged with sexual abuse and was being hunted down for child support. The once admired musician was also dropped by his record label. Kelly tried to defend himself during an interview with CBS’ Gayle King but ended up becoming unraveled and emotional during their cringe-worthy sit-down. In a dramatic move that will have implications for the coming 2020 election, the Trump administration Monday night reversed its previous position and asked a federal appeals court to strike down the entire the Affordable Care Act.

The Justice Department said it now agrees with the plaintiffs in a lawsuit challenging the law — a group of Republican attorneys general and governors.

In December, U.S. District Judge Reed O’Connor in Fort Worth, Texas, agreed with the GOP plaintiffs, saying that because the 2017 tax law passed by Congress eliminated the tax penalty for not having health insurance coverage, the rest of the health law is now unconstitutional.

A group of Democratic attorneys general, led by California’s Xavier Becerra, appealed that ruling to the 5th Circuit Court of Appeals. The law remains in place while the case proceeds.

The Trump administration originally declined to accept the plaintiffs’ argument. Instead, officials argued that since the tax was now gone, the provisions of the law requiring insurance companies to sell to people with preexisting conditions and not charge them more should fall.

Now that position has changed.

“The Department of Justice has determined that the district court’s judgment should be affirmed,” said a terse letter from Assistant Attorney General Joseph “Jody” Hunt to the appeals court handling the case. That means the administration is now formally supporting elimination of the entire ACA.

The Department of Health and Human Services declined to comment on the change and referred all questions to the Justice Department.

President Donald Trump has repeatedly called for the law to be repealed and replaced, but when Republicans controlled Congress they could not muster the necessary votes. Just last week, he lashed out at the late Sen. John McCain (R-Ariz.) for failing to support that effort.

The government’s court filing came on the same day federal officials announced that more than 11 million people used the insurance marketplaces set up by the law to purchase policies this year. The Justice Department move also occurred hours before House Democrats were scheduled to unveil their proposal to shore up the health law — setting up another battle line for the 2020 contests.

But Democrats on Monday night were quick to challenge the latest action.

“While the Trump Administration broadens its monstrous ambitions from destroying protections for pre-existing conditions to tearing down every last benefit and protection the Affordable Care Act provides, Democrats are fiercely defending the law of the land and protecting all Americans’ health care,” said a statement from House Speaker Nancy Pelosi.

Senate Minority Leader Chuck Schumer blasted the move in comments on the Senate floor Tuesday morning. “In two short sentences, the Trump administration crystallized its position that the health care coverage enjoyed by nearly 20 million people, as well as the protections by tens of millions more with preexisting conditions, should be annihilated,” he said.

Lawyers who have been following the case call the administration’s actions more than unusual.

“Much as it may dislike the fact, the Trump administration has an obligation to defend acts of Congress,” wrote Nicholas Bagley, a University of Michigan law professor and a former Justice Department attorney, in a blog post.

Invalidating the ACA could also have enormous effects on the entire health system. It would end not only the health exchanges, but also the expansion of the Medicaid program, numerous changes to Medicare and protections for people with employer-provided coverage.

“The act is now part of the plumbing of the health care system,” Bagley wrote. “Which means the Trump administration has now committed itself to a legal position that would inflict untold damage on the American public.”

Court Reinstates Murder Conviction For Former NFL Star Aaron Hernandez

(BOSTON) — Massachusetts’ highest court on Wednesday reinstated the late Aaron Hernandez’s murder conviction, which was erased after the former NFL star killed himself in prison.

The Supreme Judicial Court also scrapped the legal principle that wiped out Hernandez’s conviction for future cases, calling it “outdated and no longer consonant with the circumstances of contemporary life.”

Hernandez was convicted in 2015 of killing semi-professional football player Odin Lloyd. Two years later, the 27-year-old killed himself in his prison cell days after being acquitted of most charges in a separate double-murder case.

A judge threw out Hernandez’s conviction that year, citing the legal principle that holds that a defendant convicted at trial who dies before an appeal is heard should no longer be considered guilty in the eyes of the law, thereby returning the case to its pretrial status.

Under the doctrine, rooted in centuries of English law, a conviction should not be considered final until an appeal can determine whether mistakes were made that deprived the defendant of a fair trial, legal experts say.

Prosecutors have said the legal doctrine is outdated and unfair to victims. Bristol County District Attorney Thomas Quinn II argued the defendant’s estate should be allowed to appeal the case, if they wish. Otherwise, the conviction should stand, he said.

“He goes through a full trial, a jury who speaks for the public convicts him and because he dies, in this case commits suicide, the whole thing is wiped out like it never happened? It’s not fair or just and should be changed,” Quinn told reporters after the November hearing.

Under the new rule laid out by the court, the conviction will stand but the court record will note the conviction was neither affirmed nor reversed because the defendant died while the appeal was pending.

Other high-profile Massachusetts criminals whose convictions have been erased after their deaths include John Salvi, who was convicted of killing two abortion clinic workers and wounding five other people during a shooting rampage in Brookline in 1994.

Roman Catholic priest John Geoghan, a key figure in the clergy sex abuse scandal that rocked the Boston archdiocese and spread across the globe, also had his child molestation conviction vacated after he was beaten to death in 2003 in his cell at the same Massachusetts maximum-security prison where Hernandez died.

Hernandez’s attorney had previously argued the legal doctrine should remain intact, saying juries make mistakes.

How other states handle cases such as Hernandez’s varies widely. Some states, like Massachusetts, toss the convictions, while others dismiss the defendant’s appeal and the conviction stands. Other states allow appellate courts to consider a dead defendant’s case, prosecutors say.

European Court of Human Rights Sides With Amanda Knox—to a Point

ROME—In March 2015, Italy’s highest court definitively acquitted American exchange student Amanda Knox and her erstwhile boyfriend Raffaele Sollecito of the murder of her British roommate Meredith Kercher in Perugia in 2007. She and Sollecito had been twice convicted of the heinous crime, but the final acquittal in Rome was not the final word.

On Thursday, the European Court of Human Rights decided that Italy violated some of Knox’s rights when they originally interrogated her, backing up her claim that she was denied an interpreter or a lawyer and that the interrogators hit her. But they did not support her claim that she had been treated inhumanely.

“The court further observed that at the hearing of 17 December 2007, Ms. Knox had stated that she had been deprived of sleep until she incriminated D.L.,” the court ruling reads, referring to Patrick Diya Lumumba, the full name of the man she initially accused of committing her roommate’s murder. “She had also complained about the limited choice of food offered to her during the period in question. Moreover, the extreme emotional shock that she had sustained during the police interviews had been mentioned in her statement and in that of the interpreter.”

We’re told prosecutors expressed their frustration that Cardi herself was a no-show considering they’ve already given her a 6-week extension on the case … so they asked the judge to issue a bench warrant.

The judge denied the immediate request, but did issue a serious warning — Cardi must appear in court Friday morning — or there will most likely be a warrant issued. 

Cardi’s defense team also revealed in court they’ve been having a tough time getting in touch with her directly — instead only communicating through Cardi’s management team — and only found out Thursday Cardi had a prior commitment that would prevent her from attending Monday’s hearing.

TMZ broke the story … Cardi is accused of unleashing her posse on 2 strip club bartenders — Jade and Baddie Gi — and badly injuring both. Jade told us … prior to the attack, Cardi had threatened her for months, accusing the two of sleeping with her husband, Offset.

George Lopez Due In Court After Hooters Fight With MAGA Boob

George Lopez, the comedian who filmed himself pretending to urinate on Donald Trump’s star on the Hollywood Walk of Fame, will appear in court next month on a misdemeanor battery charge after he lashed out at a troll who provoked him with Trump jokes at a New Mexico Hooters, TMZ reports.

As the comedian was leaving the restaurant, the cellphone wielding hater, who had earlier been yelling “MAGA” at Lopez, started shouting, “Here comes my boy George! George wants to fight with me!”

A scuffle ensued and according to a police report, obtained by TMZ, cops tracked Lopez down the next day at a golf course where he told them he didn’t want to be filmed, and had tried grabbing the guy’s phone away.
