CMS Ignores Federal Judge Ruling To Approve Medicaid Work Rules in Utah

Less than 48 hours after a federal judge struck down Medicaid work requirements, the Centers for Medicare & Medicaid Services on Friday gave Utah permission to use those mandates.

CMS Administrator Seema Verma said in her approval letter that requiring Medicaid enrollees to work was allowed because it helps make them healthier.

“Therefore we believe an objective of the Medicaid program, in addition to paying for services, is to advance the health and wellness needs of its beneficiaries, and that it is appropriate for the state to structure its demonstration project in a manner that prioritizes meeting those needs,” she wrote.

Verma’s stance runs directly counter to U.S. District Court Judge James Boasberg, who in twin rulings Wednesday said work requirements in Arkansas and Kentucky are illegal under the 1965 Medicaid law. Boasberg said several times that promoting health was not the objective of Medicaid, despite that opinion from Verma and Health and Human Services Secretary Alex Azar.

In his Kentucky ruling, Boasberg wrote that using health as an objective would be “arbitrary and capricious.”

Promoting health, he added, is “far afield of the basic purpose of Medicaid: ‘reimbursing certain costs of medical treatment for needy persons.’”

Verma noted that Utah is structuring its program somewhat differently than other states.

Sara Rosenbaum, professor of health law and policy at George Washington University in Washington, D.C., said the Trump administration is “doubling down” by allowing a state to add work requirements.

“This is such a remarkable example of sticking a finger in the eye of the court,” Rosenbaum said. “We will see what happens. Because when you disrespect a court, it can backfire.”

CMS’ approval also allows Utah to cap enrollment if the state runs out of money.

Health experts said Utah’s letter clearly shows that the Trump administration plans to appeal Boasberg’s decision.

In addition to Kentucky, Arkansas and Utah, CMA has approved Medicaid work requirements in Arizona, Indiana, Michigan, New Hampshire, Ohio and Wisconsin.

Verma’s approval was for an application that Utah made in 2018. It will partly expand Medicaid to cover all adults under the poverty level ($ 12,490 for an individual this year). Enrollees will be asked to make some job searches but they will not be required to report a certain number of hours of work.

In November, Utah voters approved a ballot measure calling for the expansion to 138 percent of the federal poverty level (about $ 17,200) as allowed under the Affordable Care Act.

State officials expect about 90,000 people to gain coverage under the expansion approved Friday. About 150,000 people would have been covered under the plan approved by voters.

The plan approved Friday will require Utah to pay a bigger portion of the costs for the new enrollees because they will enter Medicaid under the traditional program and the state will get a 70 percent contribution from the federal government to cover their care. If the state had expanded to 138 percent of poverty, the federal government would have paid 90 percent of the costs.

November’s vote raised concerns among state officials, who have opposed Medicaid expansion for years. They have opted instead to prepare another request to CMS that seeks the full 90 percent funding for the new enrollees. But to secure that, Utah is offering to accept unprecedented annual limits on federal and state spending.

Allison Hoffman, a law professor at the University of Pennsylvania, said getting a federal judge to accept the premise that Medicaid is improving health is vital to getting work requirements through the courts. Federal officials “need a judge to buy that,” Hoffman said. “They are going to fish for a different jurisdiction to push this opinion.”

What’s most compelling about the Utah approval, Hoffman said, is how the state legislature ignored the will of voters who approved the referendum. “The legislature is blocking what people voted for … and it appears to be an anti-democratic move.”

Federal Judge Again Blocks Medicaid Work Requirements

For a second time in nine months, the same federal judge has struck down the Trump administration’s plan to force some Medicaid recipients to work to maintain benefits.

The ruling Wednesday by U.S. District Judge James Boasberg blocks Kentucky from implementing the work requirements and Arkansas from continuing is program. More than 18,000 Arkansas enrollees have lost Medicaid coverage since the state began the mandate last summer.

Boasberg said that the approval of work requirements by the Department of Health and Human Services “is arbitrary and capricious because it did not address … how the project would implicate the ‘core’ objective of Medicaid: the provision of medical coverage to the needy.”

The decision could have repercussions nationally. The Trump administration has approved a total of eight states for work requirements, and seven more states are pending.

Still, health experts say it’s likely the decision won’t stop the administration or conservative states from moving forward. Many predict the issue will ultimately be decided by the Supreme Court.

Kentucky Gov. Matt Bevin, a Republican, has threatened to scrap the Medicaid expansion unless his state is allowed to proceed with the new rules, a move that would drop more than 400,000 new enrollees. He said the work requirement will help move some adults off the program so the state has enough money to help other enrollees.

Bevin, who is running for re-election this fall, had threatened to end the Medicaid expansion during his last campaign but backed off that pledge after his victory.

Kentucky had been slated to begin its work requirement next Monday, but current provisions will instead stay in place, according to Adam Meier, who heads up the state’s Medicaid program. He said officials there believe they have “an excellent record for appeal and are currently considering next steps.”

Arkansas Gov. Asa Hutchinson said he was disappointed with the decision. He added that he would read review the opinion overnight and announce Thursday how the state would respond.

In his decision on Kentucky, Boasberg criticized HHS officials for approving the state’s second effort to institute work requirements partly because Bevin threatened to end the Medicaid expansion without it.

Under this reasoning, he said, states could threaten to end their expansion or do away with Medicaid “if the Secretary does not approve whatever waiver of whatever Medicaid requirements they wish to obtain. The Secretary could then always approve those waivers, no matter how few people remain on Medicaid thereafter because any waiver would be coverage promoting compared to a world in which the state offers no coverage at all.”

In a statement, Seema Verma, the head of the Centers for Medicare &  Medicaid Services, suggested the rulings would not dissuade her efforts to approve work requirements in other states. The administration wants “to give states greater flexibility to help low income Americans rise out of poverty,” she said and will “vigorously support their innovative, state-driven efforts to develop and test reforms that will advance the objectives of the Medicaid program.”

The decision by federal officials in 2018 to link work or other activities such as schooling or caregiving to eligibility for benefits is a historic change for Medicaid, which is designed to provide safety-net care for low-income individuals.

Top Trump administration officials have promoted work requirements, saying they incentivize beneficiaries to lead healthier lives. Democrats and advocates for the poor decry the effort as a way to curtail enrollment in the state-federal health insurance entitlement program that covers 72 million Americans.

Despite the full-court press by conservatives, most Medicaid enrollees already work, are seeking work or go to school or care for a loved one, studies show.

Critics of the work policy hailed the latest ruling, which many expected since Boasberg last June stopped Kentucky from moving ahead with an earlier plan for work requirements. The judge then also blasted HHS Secretary Alex Azar for failing to adequately consider the effects the policy.

“This is a historic decision and a major victory for Medicaid beneficiaries,” said Joan Alker, executive director for the Georgetown University Center for Children and Families. “The message to other states considering work requirements is clear — they are not compatible with the objectives of the Medicaid program.”

Sally Pipes, president of the conservative San Francisco-based Pacific Research Institute, called the ruling “a major blow” to the Trump administration but said this won’t end its efforts. “The Department of Health and Human Services is very committed to work requirements under Medicaid,” she said.

“It is my feeling that those who are on Medicaid who are capable of working should be required to work, volunteer, or take classes to help them become qualified to work,” Pipes said. “Then there will be more funding available for those who truly need the program and less pressure on state budgets.”

Several states, including Virginia and Kentucky, have used the prospect of work rules to build support among conservatives to support Medicaid expansion, which was one of the key provisions of the Affordable Care Act. That expansion has added more than 15 million adults to the program since 2014.

Previously the program mainly covered children, parents and the disabled.

Particularly irksome to advocates for the poor: Some states, including Alabama, which didn’t expand Medicaid, are seeking work requirements in the traditional Medicaid program for parents with incomes as low as $ 4,000 a year.

The legal battle centers on two issues — whether the requirements are permissible under the Medicaid program and whether the administration overstepped its authority on allowing states to test new ways of operating the program.

Alker said that state requests for Medicare waivers in the past have involved experiments that would expand coverage or make the program more efficient. The work requirements mark the first time a waiver explicitly let states reduce the number of people covered by the program.

States such as Kentucky have predicted its new work requirement would lead to tens of thousands of enrollees losing Medicaid benefits, though states argued some of them would get coverage from new jobs.

Under the work requirements — which vary among the states in terms of what age groups are exempt and how many hours are needed — enrollees generally have to prove they have a job, go to school or are volunteers. There are exceptions for people who are ill or taking care of a family member.

In Arkansas, thousands of adults failed to tell the state their work status for three consecutive months, which led to disenrollment. For the first several months last year, Arkansas allowed Medicaid recipients to report their work hours only online. Advocates for the poor said the state’s website was confusing to navigate, particularly for people with limited computer skills.

While the administration said it wanted to test the work requirements, none of the states that have been cleared to begin have a plan to track whether enrollees find jobs or improve their health — the key goals of the program, according to a story in the Los Angeles Times.

Craig Wilson, director of health policy at the Arkansas Center for Health Improvement, a nonpartisan health research group, said he believes policymakers will appeal court rulings all the way to the Supreme Court.

“As long as they hold on to hope that some judge will rule in their favor, states will continue to pursue work requirements,” he said.

Say What Now? Man Who Went Viral for Dropping $500 on Girl Scout Cookies Has Been ARRESTED in Long-Term Federal Drug Investigation

The man in a viral photo who spent more than $ 500 cash to buy 121 boxes of Girl Scout cookies so two Girl Scouts wouldn’t have to stand in the rain, has been arrested in a long-term federal drug investigation.

The photo went viral quickly, garnering nearly 10 thousand Facebook shares in 5 days with people praising the thoughtful gesture.

WSPA set out to cover the act of kindness Tuesday, interviewing both of the scouts and the woman who took the photo. However, late in the afternoon, WSPA learned that the mystery man, identified as Detric McGowan, was arrested Tuesday morning by the U.S. Drug Enforcement Agency (DEA).

He is accused of conspiracy to manufacture and distribute heroin, cocaine and fentanyl. McGowan allegedly tried to import drugs from Mexico.

According to the local DEA, McGowan was taken into custody at his home in a rural part of Laurens County, where cash and other assets were seized by U.S. Marshals.

Resident Agent Mike Rzepczynski of the DEA told 7-News Reporter Kirsten Glavin over the phone that McGowan’s arrest was part of a long-term federal drug investigation that began in September 2018 and spanned out of state.

McGowan faced a judge Tuesday afternoon, along with several others who were arrested in this operation. 

We’re told he will have a bond hearing on Friday.

McGowan remains in the custody of the U.S. Marshals.

According to the indictment, Detric McGowan has been charged with the following:

  • Conspiracy to possess with intent to distribute controlled substances,
  • Conspiracy to import controlled substances
  • Conspiracy to commit bulk cash smuggling ($ 1,004,665.00),
  • Interstate travel and transportation in aid of drug trafficking business,
  • Possession with intent to distribute and distribution of heroin,
  • Maintaining a drug-involved premise,
  • Conspiracy to structure transactions to evade reporting requirement
  • Three counts of unlawful use of a communication facility.

Yikes. Now we know why he was so comfortable dropping $ 500 on some cookies.

Michael Moore Calls on All Federal Workers to Stay Home

The last time he was on Stephen Colbert’s Late Show, Michael Moore said that that only way to stop President Donald Trump would be to “put our bodies on the line.” On Thursday night, he had issued a new challenge, this one to the 800,000 federal workers who are either furloughed or working without pay during the government shutdown.

“Any sane person—even if they’re for the wall—knows this is crazy that we’re in month two of this,” the director of Fahrenheit 11/9 said. “Nobody should be working without pay.”

Asked by Colbert how this whole thing will end, Moore said there’s an “easy way” to end it. “Federal workers, don’t go to work without pay,” he said. “And we, the people, we shouldn’t be supporting anything that requires someone who’s not paid working for us.” He went on to urge all Americans to stop taking flights and delay filing their tax paperwork to the IRS until the government reopens.

8 Side Gigs for Federal Workers Affected by the Government Shutdown

There’s no need to state the obvious here, especially if you’re a government employee.

The government has been shut down for more than a month, and many federal workers have now missed their second paycheck. Thousands have applied for unemployment, according to The New York Times and, while idle, many seek side gigs.

During this time, it’s difficult to know what to do. If you’re working without pay, you have little time to look for income elsewhere. If you’re furloughed, who’s going to hire you knowing you could leave to take your government job back at any time? But you need the income.

Although a side gig — or even two or three — won’t necessarily replace your lost or delayed income, it can help offset some of these challenges. It’s temporary work that pays relatively quickly.

Here are a few ideas to get you started.

1. Take on Freelance Assignments

You’ve got skills, so flaunt them.

Upwork is a great platform if you’re just wading into the freelance world.

Once you create a profile, search through thousands of gigs based on your skills and interests. If you find one you’re interested in, apply.

One of the perks of Upwork is that it handles all financial transactions, eliminating any unease or questions of, “Will they really pay me?!” Upwork takes a 20% fee for the first $ 500 you bill with each client.

Fiverr is another freelance platform you can check out if you don’t have luck on Upwork.

2. Share Your Spare Room (or Couch) With Travelers

If you have a spare room, you might as well try to earn some money by listing it on Airbnb.

If you’re a good host with a desirable space, you could earn enough money to offset the cost of rent or mortgage payments.

And, hey, even if you don’t have a spare room, you can get in on the Airbnb action. Folks across the country are getting creative.

A few simple steps can make the difference between a great experience and a less-than-satisfactory one. We talked to Terence Michael, an Airbnb superhost based in Los Angeles.

Here are some of his tips:

  • Break out the labelmaker. “I have the entire house loaded with labels,” says Michael. “They look nice; they’re modern. This helps people feel less helpless.”
  • Be a good host, and stock your place with the toiletries you’d expect at a hotel — toilet paper, soap and towels. Here’s a little hack from Michael: “I order on Amazon and have it delivered when people are there.”
  • Be kind to your neighbors. “I say, ‘I’m not going to put anyone here who I think won’t be good for you,’” Michael explains. “And I turn a lot of big groups away, especially in Nashville. I don’t want anyone going to the cops or the city.”

3. Drive People Around Town

Instead of watching your car sit idly in the driveway, use it to make some extra money. No, it’s not going to replace your paycheck, but it is a fairly simple side gig.

Try driving with Lyft. To be eligible, you’ll need to be at least 21 years old with a year of driving experience, pass a background check and own a car made in 2007 or later.

Because it’s simple to switch between apps, many Lyft drivers also sign up as a driver partner with Uber.

As a partner driver with Uber, you’re an independent contractor. You set your own schedule and work as much or as little as you want.

If you want to give it a try, here are a few things to keep in mind: You must be at least 21 years old, have at least one year of licensed driving experience in the U.S. (three years if you’re under 23 years old), have a valid U.S. driver’s license and pass a background check.

Finally, your car must be a four-door, seat at least four passengers (excluding the driver), be registered in-state and be covered by in-state insurance.

4. Let off Some Steam, and Hang out With Dogs

If you’re totally stressed but love hanging out with dogs, Rover might be your perfect gig.

The online network connects dog walkers and sitters to local dog owners through its 4.9-star-rated app, so you don’t have to staple flyers on every utility pole across town.

Rover says sitters can earn as much as $ 1,000 a month.

Rover dog-sitter requirements vary by location. In general, you must:

  • Be 18 years or older.
  • Pass a background check.
  • Have access to the Rover app (iOS or Android).

Here’s how it works: You’ll create an online sitter profile where you’ll answer questions about your experience with puppers and your schedule availability.

You can choose to offer a variety of services, including dog walking, overnight boarding at your home or theirs, and daycare. Boarding is the app’s most popular service, so offering it can get you more gigs. You set your own rates. (Rover keeps a small percentage as a service fee.)

Dog owners will reach out to you. Accept which gigs you want, then start snugglin’ pups. As soon as you complete a service, you’ll be paid within two days.

5. Shop and Bag Groceries (No Need to Deliver)

Sure, there are a number of grocery delivery services out there (think: Shipt, PeaPod), but if you’re not into the idea of driving your car around town, there’s another option:

Instacart, a grocery-delivery service, is looking for part-time in-store shoppers who simply shop and bag orders.

To qualify, you must:

  • Be 18 or older.
  • Be eligible to work in the U.S.
  • Have access to an iPhone 5 or Android 4.4 (or newer).
  • Be able to lift 30 to 40 pounds.

You choose the hours you work (up to 29 hours a week) and get paid per order weekly. Rates will vary by location.

If you want to get real adventurous (or work more hours) you can also sign on as a full-service shopper, meaning you’ll deliver the groceries, too.

Once you sign up to become a shopper, Instacart will reach out about an orientation.

6. Help With Odd Jobs

If you’re handy, consider helping your neighbors out with odd jobs around the house.

Rather than going door to door, connect with people in your area who need help getting things done through TaskRabbit — anything from picking up dry cleaning to putting together Ikea furniture.

Keep an eye out for virtual tasks, which are mostly centered around personal assistance, administrative work or research help. You can do those and earn money without even walking out your door.

7. Find Nannying Gigs

Parents, oldest siblings and former camp counselors: This one’s for you.

Whether you want to look after school-aged kids on Saturday nights or help tired parents after school, you can find opportunities to use your childcare experience to earn cash.

Look within your circle of friends and acquaintances first, as parents are more likely to trust someone they know. Ask friends if they know anyone else who could use a few hours to themselves, whether it’s to grocery shop or simply to head to the gym.

You can also let parents find you through Care.com. Rates on the platform will vary by city, but the average rate for babysitters in 2017 was $ 16.20 an hour, according to Care.com’s 2018 Cost of Care Survey.

8. Sell Your Plasma

If you’re not afraid of needles, you could consider selling your plasma. It’s a way to get paid, and it also helps others in need.

The process takes about two hours, but it’s relatively simple. You’re free to read or watch TV while a machine draws your blood and separates the plasma.

It’s common for plasma donation centers to pay between $ 20 and $ 30 per visit, up to twice a week.

Interested? Search “plasma center + [your city]” for options, and ask your friends for referrals — many centers offer referral sign-up bonuses.

Federal Shutdown Mostly Spares Health Coverage, But Other Issues Loom

As the partial government shutdown drags on, about 800,000 federal employees who work for the shuttered agencies — and their families — are facing the reality of life without a paycheck.

And those workers need to consider a host of other related issues as they attempt to make ends meet.

For starters, what will happen to their health insurance?

For the most part, federal employees needn’t worry about that, according to the Office of Personnel Management (OPM) in an FAQ blog post.

Both the online FAQ and the health insurance industry’s trade association confirm that coverage through the Federal Employees Health Benefits (FEHB) program will continue even if some federal agencies affected by the shutdown aren’t issuing those paychecks or paying premiums.

“The shutdown should not impact their coverage,” said Kristine Grow, spokeswoman for America’s Health Insurance plans, the trade group that represents insurers, including those that offer coverage through the federal program. “It’s business as usual.”

Once the shutdown ends and those payments resume, workers should expect that their usual share of premiums plus some of the accumulated amount that wasn’t deducted during the missed pay periods will be taken out.

“Procedures may vary somewhat by payroll office, but the maximum additional deduction allowed under regulations is one pay period’s worth of premiums (in addition to the current pay period’s premium),” said an OPM spokeswoman.

What about government contract workers?

Less clear is what happens to workers under contract with the affected federal agencies — including some people working as analysts, administration assistants and janitorial staff — who are mostly excluded from the FEHB program.

Many companies that contract with the federal government offer workers insurance. The federal Office of Personnel Management recommends these contracted employees consult the human resources office at their company for answers regarding the shutdown.

“In 95 percent of cases, even if it’s not required by law, I would think most everyone would continue that coverage,” said Rachel Greszler, a senior policy analyst and research fellow at the Heritage Foundation who studies economics, budget and labor issues.

For contract workers who buy their own coverage and are struggling to pay bills without their paychecks, it’s a different story. One strategy may be to ask their insurers for a grace period in paying their premiums, similar to how the government has suggested workers seek accommodation from mortgage lenders and other creditors. But there is no requirement that insurers grant such a request.

“We are concerned about the disruption that this shutdown has caused our members and their families,” noted a corporate statement from CareFirst BlueCross BlueShield. “We are currently exploring how to best address this issue should the shut-down continue.”

What else could be affected?

Depending on how long the shutdown lasts, dental, vision and life insurance programs may start sending bills directly to workers.

Federal workers pay the premiums for these benefits themselves, according to Dan Blair, who served as both acting director and deputy director of the OPM during the early 2000s. He is now a senior counselor and fellow the Bipartisan Policy Center.

Because workers’ checks are not being processed, the amounts usually sent to these carriers each pay period also aren’t being paid. If the shutdown lasts longer than two or three pay periods, workers will get premium bills directly from these firms and should pay them “on a timely basis to ensure continuation of coverage,” the OPM says in its FAQ. Blair agrees.

There also may be a delay in processing claims for flexible spending accounts. These are special accounts in which workers use pretax money deducted from their paychecks to cover certain eligible medical expenses, such as eyeglasses, braces, copayments for doctor visits or medications, including some over-the-counter products. With no paychecks going out, these deductions are not being made and transferred into FSAs. Once paychecks start up again, the amount deducted will be adjusted so the worker will get the annual total they had requested.

During the shutdown, though, reimbursement claims to these accounts also won’t be processed, the OPM says. Blair suggests holding off on big-ticket purchases during the shutdown, if possible, and always keeping paperwork on the purchases.

Another consideration: Those who changed plans before the furlough may find their paperwork wasn’t processed in time.

In those cases, the OPM says to stick with the old health plan until the shutdown ends and the new plan is processed. The new plan will pick up any claims incurred.

How will workers know if their change was processed? The OPM’s FAQ says workers who receive an ID card in the mail are enrolled.

“The new policy will be what applies and pays benefits, but there could be some administrative burdens and hassles on the part of workers if the shutdown continues much longer, if the initial bills are not going to the right insurance company,” Greszler said.

Overall, Blair says workers should continue to monitor news media sites, particularly those that focus on federal workers and issues, looking for any updates.

“We’re getting into uncharted territory and there are always things that pop up that no one has planned for,” said Blair, who did not face any shutdowns during his tenure at OPM.
