Judge Orders File In Jussie Smollett Criminal Case Unsealed

CHICAGO (AP) — A judge in Chicago has ordered the file in the Jussie Smollett criminal case unsealed.

Cook County Judge Steven Watkins said Thursday that while there are good arguments in favor of keeping the file sealed, the “Empire” actor forfeited his rights to keep the case sealed to protect his privacy by talking to the media before and after prosecutors dismissed the charges against him.

Smollett had been charged with 16 counts alleging he lied to police when reporting he’d been the victim of a racist, anti-gay attack in January. Police insist the actor, who is black and gay, staged the attack because he was unhappy with his salary and wanted publicity.

Prosecutors dropped all charges with little explanation.

The criminal case was dismissed March 26. Smollett wanted the case sealed, saying that he had “the right to be left alone.”

Don’t be fooled. The moving expense deduction is no longer available in tax years 2018 – 2025 due to the Tax Cuts and Jobs Act (TCJA) but there are some exceptions to the rule. If you moved to a new location because of work and are a member of the military, you may qualify to use IRS Form 3903 to claim the cost of your moving expenses as a deduction on your federal income tax return.

5. Claim your Dependents

New tax laws allow you to claim a dependent credit, either $ 500 or $ 2,000 depending on the status of the dependent.

Warner Bros’ File Copyright Claim Against Trump Tweet, Has ‘Dark Night’ Music Removed

Late on Tuesday night, Warner Bros.’ Pictures were forced to file a copyright infringement complaint against President Donald Trump and The White House due to their most recent controversial tweet. The two-minute 2020 re-election campaign video, which has since been taken down by Twitter after the complaint was filed, used music from Christopher Nolan’s The Dark Knight Rises without the film studios consent.

 

The very strange video, which used the composer Hans Zimmer’s “Why Do We Fall” from the 2012 film, also used the same font from the movie, but portrayed a very different message. The text, which appears to be have been altered from another quote, said: “First they ignore you. Then they laugh at you. Then they call you a racist. Donald J. Trump. Your vote. Proved them all wrong. Trump: The Great Victory. 2020.”

The trailer-like video showed footage of Donald Trump from various rallies and events around the country, along with people who Trump would consider villains in his own superhero story, such as former President Barack Obama, his previous Democratic presidential rival Hillary Clinton, and comedians Rosie O’Donnell and Amy Schumer.

The video also highlighted Trump’s meetings with North Korean dictator Kim Jong Un and Brazil’s recently elected President Jair Bolsonaro.

After BuzzFeed News first reported that the music was used without approval, Warner Bros. took action and quickly filled a copyright claim. Last night a spokesperson from Warner Bros. said in a statement: “The use of Warner Bros.’ score from ‘The Dark Knight Rises’ in the campaign video was unauthorized. We are working through the appropriate legal channels to have it removed.”

The quick action by Warner. Bros led to Twitter removing the video after only a couple of hours, as it was deemed to have breached the social networks own copyright policies. However, this didn’t stop the video being viewed almost 1.8 million times.

This isn’t the first time that Trump has gotten into trouble for using cultural material without approval. Last year, Trump tweeted a meme based on the Game of Thrones tagline “Winter is Coming”, which said “Sanctions are Coming”, much to HBO’s displeasure.

Previously, Twitter also took steps to remove another one of Donald Trump’s tweets due to copyright infringement. Earlier this year his official Twitter account used the band R.E.M.’s most famous tracks “Everybody Hurts” in a promotional, which was taken down after the band complained to Twitter.

As the 2020 presidential race already begins to hot up, we’re sure this won’t be the last of Trump’s tweets that causes some level of controversy.

Money expert Clark Howard has long said that when you can’t afford to pay your taxes, you should go ahead and file anyway and pay whatever you can.

Then, if you can pay the remainder within four months as part of an payment plan, you’ll usually only incur a minimal penalty.

We should also note that if you’ve never been in trouble with the IRS before, you may be able to qualify for a first-time penalty abatement. Just one call to the IRS could save you hundreds or thousands of dollars in penalties and fees!

So there is a strong case to be made that filing late by a couple months is much better than not filing at all.

What to do if you haven’t filed back taxes for years

But if it’s been a year or more since you last filed, you’re probably going to have to scramble to come up with the necessary paperwork, like old W2s.

Fortunately, getting the documents you need may be easier than you think!

First off, when you’re ready to file after a long period of not filing, you’ll want to start out by getting prior-year tax return forms. The IRS makes them conveniently available online going back through the decades.

Once you start filling them out, you may find that you need past wage and income information that you don’t readily have available. If that’s the case, there are two routes you can go:

  1. Contact your employer for the required info
  2. If you can’t get in touch with the employer, file out Form 4506-T, Request for Transcript of Tax Return, and check the box on line 8

You may also need info from a prior year’s tax return. While money expert Clark Howard says you should keep your tax returns forever, maybe you didn’t heed that advice!

In that case, you can use the IRS Get Transcript feature to request what you need.

Meanwhile, if you get deep into the weeds and find you need help filing your back taxes, you can always enlist free help from the IRS.

This Is What Happens to Your Debt When You File Chapter 13 Bankruptcy

We hear about bankruptcy in the news all the time. But the type we hear about most, Chapter 11, is what businesses typically use to restructure their debts.

Chapter 7 and Chapter 13 are the bankruptcy types individuals like you and I are most likely to encounter. (You can learn about Chapter 7 bankruptcy here.)

The process can get tricky fast, so keep reading to learn who’s eligible for Chapter 13 bankruptcy and how it works.

What Is Chapter 13 Bankruptcy?

Chapter 13 bankruptcy is known as a “wage earner’s plan,” because it allows working people to make a plan to repay their debt over a three- to five-year span.

While filing Chapter 13 bankruptcy may reduce or discharge much of your debt, there are a few key exceptions: alimony, child support, some taxes, federal student loans and criminal fines.

To be eligible for Chapter 13 bankruptcy, you must:

  • Have unsecured debts (credit cards, student loans, medical bills) of less than $ 394,725.
  • Have secured debts (property, vehicles) of less than $ 1,184,200.
  • Have already gone to credit counseling individually or in a group.
  • Be working with a regular income.
  • Be current on your taxes.

If you’ve filed for Chapter 13 bankruptcy in the past two years, you’re ineligible to petition for bankruptcy again.

Is Chapter 13 Bankruptcy Better Than Chapter 7?

Chapter 7 bankruptcy is often referred to as “liquidation bankruptcy.” A court-appointed trustee takes your assets and divides the funds among your creditors. You may be able to keep your home, although exemptions for property vary by state.

Chapter 7 bankruptcy is a quicker process, lasting only a few months. If you fail the Chapter 7 means test that determines your ability to pay part of your debt, you can convert your petition for bankruptcy to one for Chapter 13.

Chapter 13 is often seen as a more attractive method of filing for bankruptcy for homeowners, because it gives you a chance to save your home from foreclosure if you’re behind on your mortgage. However, you must make all mortgage payments on time during the Chapter 13 payment plan or you’ll risk losing your home.

Another key difference between Chapter 7 bankruptcy and Chapter 13 is that in the latter, your debt due to a separation or divorce may be discharged or reduced.

During your Chapter 13 payment plan, you’re not allowed to take on any new debt without court approval. Chapter 7 is not as strict.

What Happens When You File Chapter 13?

You must pay a $ 235 filing fee and a $ 75 administrative fee to file for Chapter 13, which can be paid over four installments with permission from the bankruptcy court. The bankruptcy forms ask about creditors, the amounts you owe to them, your income, your property and your monthly expenses.

Even if only one spouse is filing for bankruptcy, both parties in a married couple must provide this information.

Debt collection stops once you file your petition for bankruptcy, so that an impartial trustee can be appointed and meet with your creditors to work out a repayment plan. You’ll also attend this meeting to answer questions about your finances and your debt repayment plan. Then, within 14 days of filing for bankruptcy, your repayment plan must be submitted to the court.

Attorneys fees can often be paid back over the course of the Chapter 13 payment plan.

How Chapter 13 Repayment Works

When you file Chapter 13, you make all debt payments to a trustee, who then sends the proper amounts to creditors. You don’t have to interact directly with the parties you owe money to.

Depending on your repayment plan, you’ll make fixed payments on a regular basis by payroll deduction or direct payments. These payments start within 30 days of filing for bankruptcy, even if your payment plan hasn’t yet been approved in a court hearing.

How much will you pay? Typically, all of your disposable income, with an allowance of 15% of your gross income for charitable contributions. If your monthly income is less than the state median for a family the size of yours, you’ll pay for three years; if you make above the median income, you’ll pay for five years.  

If you have past-due amounts on a home, car or other loans with collateral, you’ll be able to pay back those balances over the length of your payment plan.

Is Filing for Bankruptcy Right For You?

Deciding to file for bankruptcy is a deeply personal choice and one to make after careful consideration.

For some, debt feels like an insurmountable obstacle, for which bankruptcy provides a way through. It also stops the barrage of calls from debt collectors while you work toward paying off debt that doesn’t get discharged in the bankruptcy process.

The black mark on your credit will last up to 10 years, but a history of missed payments and a stretched credit limit look just as bad to potential creditors.

One family The Penny Hoarder spoke with found bankruptcy to be more challenging than they originally expected. Instead of having the freedom to make simple purchases, they felt trapped by the process. They eventually used a large tax refund to leave bankruptcy early.

For others, the shame that often comes with filing for bankruptcy is worth it for a fresh start.

A new chapter in the ongoing flap between the US and Huawei is about to get under way, with the Chinese smartphone maker reportedly planning a lawsuit to be filed against the US government later this week in Texas.

That’s where the company’s US office is located, and word of the suit comes via The New York Times, which reports that the lawsuit will focus on a defense spending authorization approved by Congress last year. In it, the federal government barred itself from using products made by Huawei as well as another Chinese hardware maker, ZTE.

To quickly, safely, and affordably repair roofing damage, you may need to file a homeowners insurance claim. It is important to find a reliable, trusted contractor for your roof replacement. This article will assist you as you navigate insurance claims, contractors, and the repair process.

Before You Contact Your Homeowners Insurance

Before contacting your insurance agent, take time to document the damage to your roof. Take multiple pictures of the interior and exterior of your home, as well as detailed notes. If the damage was caused by a storm, document the date and time.

If damage occurred from hail, it’s smart to document the size of the hail with a tape measurer. After documenting the damage, safe-proof your home to prevent further damage before contacting your insurance.

Types of Homeowner Insurance Coverage

There are usually four main coverage types to your homeowners insurance:

  • Dwelling Insurance

What is Usually Covered by Homeowners Insurance…And What’s Not

According to the reliable roofing contractors, standard homeowners policies cover a wide range of potential disasters including tornadoes, lightning strikes, fire, wind, hail, and falling objects. But it’s important to note that not all natural disasters are covered in your policy.

Like many insurance providers, Allstate notes that damage caused by floods and earthquakes are not typically part of your homeowners insurance policy. However, they are often available through additional policies. Check with your insurance provider to learn if they offer these protections.

Normal wear and tear on your home and damage due to lack of maintenance, mold, or infestation from termites or other pests are also not usually covered.

Filing a Homeowners Insurance Claim for Home Damage

Storm damage to your home will fall under your dwelling insurance. Damage may impact your roof, walls, windows, floors, foundation, or built-in appliances like your HVAC unit. Once you have documented the damage, and taken action to prevent further damage, you can begin the claims process. It is important to file a claim as soon as possible after an event.

Most companies make it easy for homeowners to navigate this process on their website or mobile app, but you can also call the number listed on your policy. To submit a claim, you will need your policy number and an explanation/summary of damages. Your insurance agent will discuss your current policy, what’s covered and your next steps.

Understanding Your Deductible

It is important to understand your homeowners insurance deductible throughout this process. This deductible is the amount you will have to pay before receiving a reimbursement from your insurance provider.

For example, if your deductible is $ 1,000, but the cost to repair your roof is $ 800, your deductible would not be met. You would not receive any money back from your insurance company. In this case, you may choose to repair the roof on your own.

If it costs $ 3,000 to repair your damaged roof, and your deductible is $ 1,000, you would file a claim and pay your deductible. Your insurance provider would cover the additional $ 2,000 cost. A typical roof repair runs between $ 150 and $ 3,000 depending on the size of damage and materials. Roof replacements range from $ 8,000 to $ 17,500.

Meeting With Local Roofing Contractors

After filing a claim, you will be asked to schedule an appointment with an insurance adjuster. Before meeting with the adjuster, we recommend receiving three to four project estimates from local, trusted contractors. These contractors should provide free estimates, but not begin any repairs yet. Keep all of the estimates and any additional relevant paperwork organized. You will share these details with your insurance adjuster at your meeting.

Make sure you don’t sign a contract or agreement or make any type of payment until your insurance provider has approved the estimate. It is important not begin repairs until after the adjuster has inspected your home, as that may lead to not receiving compensation.

If possible, ask your roofing contractor to be present at your appointment with the insurance adjuster. This will protect you from any overlooked damages and will also ensure that you get a fair assessment.

Beware of Scams

While most contractors are reliable, there are scammers who seek out neighborhoods with a high percentage of senior citizens; areas with older housing stock; and places that are prone to, or were recently hit by major storms.

The reliable roofing contractors reports that in the aftermath of a natural disaster salespeople often go door-to-door in damaged neighborhoods offering cleanup and/or repair services. While many of these individuals are honest and reputable, others are not. The dishonest individuals may pocket your payment or insurance settlement without completing the job. Or, they may use inferior materials and perform shoddy work not up to code. The crime bureau also warns of contractors who offer to manipulate the price to cover your deductible or extra work not caused by the catastrophe. This is insurance fraud, a felony which may render insurance coverage void.

Meet With Your Insurance Adjuster

After receiving your contractor estimates, make an appointment with your insurance adjuster. They will help determine the cause of damage and assess the total cost. When the adjuster meets you at your home, they will ask you about the event. This is where your detailed notes will be important. The adjuster will create a report that contains a description of the roof damage, as well as photos. It is also important to share the estimates you received from contractors at this meeting. All of these details will be submitted to the insurance company to move your claim along.

Hire Your Preferred Contractor to Repair Roof Damage

Once your claim has been approved, and you have reached a settlement for the cost of repairs, begin working with your preferred, licensed contractor to repair your roof. Your insurance provider will typically send an advance for half of the payment to allow you to begin repairs. The last half will be sent upon completion, minus your deductible.

Primera Air Ceases Operations; To File For Bankruptcy

European discount airline Primera Air has ceased all operations from Tuesday, October 2, and is filing for bankruptcy protection. In an email sent to the airline’s employees, Primera’s director of flight operations informed that both Primera Air Nordic and Primera Air Scandinavia will file for bankruptcy on Tuesday. The airline is owned by the Primera Travel Group.
