According to Forbes, the son and estate of Broadway composer Harold Arlen has filed a lawsuit against Apple, Amazon, Google, Microsoft, and Pandora, for selling over 6,000 unauthorized recordings of his music.

Florida Man Files Motion To Compel Lawyer To Wear Better Shoes

Dress for the job you want, but never dress so well that people wouldn’t feel bad about sticking it to you. So goes the logic of Bill Bone, a Florida attorney who filed a motion in June of 2009 to compel his opposing counsel to wear better shoes. Bone suspected his opposing counsel was wearing ugly shoes as a ruse to impress the jury. Or, as he puts it, “make them believe [he] is humble and simple without sophistication.” A transcript of the filed motion:

PLAINTIFFS’ MOTION TO COMPEL DEFENSE COUNSEL TO WEAR APPROPRIATE SHOES AT TRIAL

Plaintiff moves the Court relief as follows:

This is an action alleging personal injury to Plantiff as a result of a car collision which occurred on December 8, 2002.

Trial is set to begin on June 15, 2009.

It is well known in the legal community that Michael Robb, Esquire wears shoes with holes in the soles when he is in trial.

Upon reasonable belief, Plaintiff believes that Mr. Robb wears these shoes as a ruse to impress the jury and make them believe Mr. Robb is humble and simple without sophistication.

Throughout the discovery of this case, Mr. Robb’s clear strategy has been to attack the credibility of the Plaintiff and his counsel by suggesting the Plaintiff is faking his injuries and exaggerating his claims and demanding more compensation than he deserves because Plaintiff is greedy.

Part of this strategy is to present Mr. Robb and his client as modest individuals who are so frugal that Mr. Robb has to wear shoes with holes in the soles. Mr. Robb is known to stand at sidebar with one foot crossed casually beside the other so that the holes in his shoes are readily apparent to the jury who are intently watching the counsel and the Court at that moment.

Then, during argument and throughout the case,  Mr. Robb throws out statements like “I am just a simple lawyer” with the obvious suggestion that Plaintiff’s counsel and the Plaintiff are not as sincere and down to earth as Mr. Robb.

Mr. Robb should be required to wear shoes without holes in the soles at trial to avoid the unfair prejudice suggested by this conduct.

WHEREFORE,  Plaintiff prays this honorable court grant the relief herein requested.

At press time, I am currently wearing shoes with holes in them, asking my employer for a raise while casually throwing out phrases such as, “I am just a simple blogger.”

Nipsey Hussle’s Sister Files for Guardianship of His Daughter Emani

Nipsey Hussle’s sister, Samantha Smith has filed for legal guardianship of one of his children.

She filed documents in L.A. County Superior Court asking for guardianship of 7-year-old Emani Asghedom.

Sources say Samantha believes the child’s biological mother is unable to care for the child.

We’re told Nipsey cared for Emani before his death March 31 after being gunned down at his L.A. clothing store.

Samantha says she has assisted in the care of Emani throughout her life and wants “to ensure the continued stability for Emani and ensure that she will be able to maintain her current and ongoing relationship” with Nipsey’s family.

Nipsey had another child, 2-year-old Kross, with Lauren London. Kross is not the subject of the conservatorship. Kross lives with Lauren.

On April 2, Samantha posted in her Instagram account a tribute to Nipsey, and in it she says, “I got Emani.”

The judge has yet to rule on the guardianship petition.  

We hope this doesn’t get messy.

Wendy Williams Files For Divorce From Kevin Hunter After 22 Years Of Marriage!

Stop the presses!! Wendy Williams apparently has finally awaken from her nightmare marriage and filed divorce papers on Kevin Hunter.

Williams’ attorney confirmed to Page Six on Thursday that it’s OVER and that Williams is divorcing her husband of 22 years. Williams, who filed in Essex County, NJ, served Hunter with divorce papers at 6:30 a.m, according to a source, the site says.

“Thank you to everyone for respecting the family’s privacy during this time,” the personal representative for Williams told Page Six in a statement. “Kevin is supportive of Wendy and they are working through this process together.”

The split comes amid renewed rumors that Hunter has been cheating on Williams, 54, with a woman named Sharina Hudson, who gave birth to a baby suspected to be Hunter’s last month.

The divorce news comes after Williams notably flaunted her lack of a wedding bandearly Thursday on her hairstylist’s and makeup artist’s social media.

Rumors of infidelity have plagued the couple for a few years, though Williams never confirmed them. She vaguely addressed her marital woes on her show earlier this year, cryptically telling viewers after she returned from a two-month hiatus that her wedding ring would always stay on her hand.

“I’m still very much in love with my husband,” she said. “Don’t ask me about mine.” Pointing to her wedding ring, Williams added, “It ain’t going anywhere. Not in this lifetime.”

However, her ring apparently did go somewhere. On March 25, upon leaving the sober living facility where she has been staying after receiving help for addiction in Florida (though she previously told viewers she was seeking treatment for her Graves’ disease), the morning show host was spotted without her flashy jewelry. She appeared to put it back on to tape her show later that day, but an insider had told us it wasn’t her real ring.

Hunter’s infidelity wasn’t the only thing rumored to be wrong with Williams and Hunter’s marriage. Previous reports have have stated that Hunter’s allegedly abusive behavior ultimately led to the unraveling that prompted Williams to relapse.

She would hide in the bathroom and tell me to knock on the door when he left the office so she wouldn’t have to see him,” an intern from Williams’ former radio show told The Post, adding that it was common for Hunter to pull Williams into a private room and for staff to hear them fighting.

TMZ reports:

The singer filed the paperwork earlier this month in Atlanta. Monica and Shannon have a 5-year-old daughter named Laiyah together, and she has 2 sons from a previous relationship with rapper Rocko.

So far there are no details on whether she’s seeking child or spousal support … but we’ve learned Monica was unsuccessful in sealing the divorce docs.

The couple wed in 2010, but there was speculation they were separated in October 2018 … until she shared a loving photo of the 2 together on Instagram. She hasn’t been wearing her ring in Instagram photos for a few weeks though.

Neither Monica or Shannon Brown are speaking publicly about the matter.

Former Black Employee Files Suit Against Moschino for Racially Profiling Black Shoppers

Shamael Lataillade, a former employee at a Moschino boutique in West Hollywood, California, filed a lawsuit against the Italian luxury clothing company for racial discrimination against her and shoppers of color. In the suit, Lataillade claims that employees at the store were instructed to racially profile black patrons who didn’t appear to be wealthy and classify them using a racist codename.

Lataillade says a store supervisor would call black clientele “Serena” and ordered employees to follow and watch them closely if they weren’t wearing diamonds or name brand clothing, according to documents obtained by TMZ. Associates were also told to tell so-called “Serenas” that certain items were out of stock. The female supervisor even went as far as sometimes recording the license plate numbers of black clients. In one instance, she purportedly called the police to report a “suspicious” customer who Lataillade says turned out to be a high-profile rapper.

In addition, Lataillade, who is a Haitian-American woman, claims that the supervisor stereotyped her as someone who practices voodoo. Lataillade argues that she was then fired for speaking out about the “Serena” code word and other forms of racism she faced.

Ironically, the code word “Serena” seems to be a reference to iconic tennis star Serena Williams, who boasts a net worth around $ 180 million.

In response to the suit, which seeks unspecified damages, Moschino denied Lataillade’s charges and told TMZ the company “complies with applicable equal employment laws and values and respects all customers and clients regardless of their race or background.”

Nevertheless, this lawsuit points to the notorious phenomenon of “shopping while black,” an epidemic that dates back to the 20th century, when department stores prohibited black shoppers from using their main entrance and trying on clothes in fear their skin would tarnished items. Oprah Winfrey even fell victim to the “shopping while black” stigma back in 2013, when a Zurich store clerk snubbed the billionaire and suggested that she could not afford a $ 38,000 purse.

USA Gymnastics Files For Bankruptcy in Wake of Sex Abuse Scandal

USA Gymnastics is turning to bankruptcy in an effort to ensure its survival.

The embattled organization filed a Chapter 11 bankruptcy petition on Wednesday as it attempts to reach settlements in the dozens of sex-abuse lawsuits it faces and to forestall its potential demise at the hands of the U.S. Olympic Committee.

USA Gymnastics filed the petition in Indianapolis, where it is based. It faces 100 lawsuits representing 350 athletes in various courts across the country who blame the group for failing to supervise Larry Nassar, a team doctor accused of molesting them.

Kathryn Carson, who was recently elected chairwoman of the board of directors, said the organization is turning to bankruptcy to speed things up after mediation attempts failed to gain traction.

“Those discussions were not moving at any pace,” Carson said. “We as a board felt this was a critical imperative and decided to take this action.”

The filing does not affect the amount of money available to victims, which would come from previously purchased insurance coverage, she said. Carson said the insurance companies “are aware we’re taking this action and our expectation is they will come to the table and pay on our coverage.”

Carson added: “This is not a liquidation. This is a reorganization.”

One that USA Gymnastics hopes will buy it enough time to fend off the USOC’s intent to decertify it.

The USOC on Nov. 5 took steps to remove USAG as the sport’s governing body at the Olympic level — a step that’s taken only under the most extreme circumstances. In an open letter to the gymnastics community, USOC CEO Sarah Hirshland said “you deserve better,” and that the challenges facing USA Gymnastics were more than it was capable of overcoming as currently constructed.

Carson said the legal maneuvering Wednesday delays the USOC’s efforts to strip its designation as a national governing body.

“We always have a dialogue going with them and intend to make it clear with them we have a lot to talk about and we want to keep that going,” Carson said.

USOC spokesman Patrick Sandusky disagreed.

“While we fully understand that USAG believes this restructuring will begin to solve deficiencies we’ve identified, the filing does not impact our Section 8 complaint and that process will move forward,” Sandusky said.
