In tense hearing, Barr defends clearing Trump on obstruction of justice

Under pressure from Democrats, Attorney General William Barr on Wednesday defended his decision to clear President Donald Trump of criminal obstruction of justice by attempting to impede Special Counsel Robert Mueller’s Russia inquiry and criticized Mueller for not reaching a conclusion of his own on the issue.

Justice Department warns Academy over potentially excluding Netflix

The feud between Netflix and the old Hollywood guard who’d like to exclude the streaming service has a new challenger: the Department of Justice.

The head of the DOJ’s antitrust division has sent a letter to the Academy of Motion Pictures and Sciences, which runs the Oscars, warning the organization over potential antitrust violations if it decides to exclude streaming services from future award shows.

In the letter obtained by Variety,  DOJ antitrust chief Makan Delrahim writes that “in the event that the Academy — an association that includes multiple competitors in its membership — establishes certain eligibility requirements for the Oscars that eliminate competition without procompetitive justification, such conduct may raise antitrust concerns.” Read more…

Jussie Smollett Returns to Set, Tells ‘Empire’ Cast He’s Innocent + Feels ‘Betrayed’ By the Criminal Justice System [Video]

Jussie Smollett returned to work on ‘Empire’ today after getting arrested and charged with felony disorderly conduct for allegedly faking his hate crime.

Sources on the “Empire” set tell us the cast and crew were waiting at least 30 minutes for Jussie to begin the scheduled scene. When he eventually showed his face he was very emotional, and surrounded by his family.

We’re told he addressed everyone on set, saying …”I’m sorry I’ve put you all through this and not answered any calls. I wanted to say I’m sorry and, you know me, I would never do this to any of you, you are my family. I swear to God, I did not do this.”

After that, he left the set. We’re told it was obvious Jussie had been crying a lot, so producers said he would have to come back later. He did, and we’re told he is currently shooting the scene.

Aside from that, his reps released a statement saying he ‘feels betrayed’ by the criminal justice system.

“Today we witnessed an organized law enforcement spectacle that has no place in the American legal system,” read a statement put out on the actor’s behalf following his release from custody Thursday afternoon. “The presumption of innocence, a bedrock in the search for justice, was trampled upon at the expense of Mr. Smollett and notably, on the eve of a Mayoral election. Mr. Smollett is a young man of impeccable character and integrity who fiercely and solemnly maintains his innocence and feels betrayed by a system that apparently wants to skip due process and proceed directly to sentencing.”

Jussie was released from Chicago police custody after posting bail and surrendering his passport during a bond hearing in front of State of Illinois Circuit Court of Cook County Judge John Fitzgerald Lyke Jr.

His bail was set at $ 100,000, with the actor required to post $ 10,000 (10 percent) for release.

“We knew about his flagrant attempts to stop investigations into what Russia did to our election,” the host said, noting that even the Times article acknowledged that, “Americans have lost track of how unusual his behavior is.”

Theatrical Release of the Week: Birds of Passage

Directed by Cristina Gallego and Ciro Guerra; Written by Maria Camila Arias and Jacques Toulemonde Vidal

Based on a true story, Colombia-set Birds of Passage tells the story of the Wayuu, an indigenous group ravaged by the drug war. Kicking off in 1968, the epic is told in five parts and spans a dozen years. We witness Zaida (Natalia Reyes), a young woman from the revered Pushaina clan, performing an elaborate coming-of-age dance that attracts the attention of Rapayet (José Acosta), a poor orphan raised by his uncle.

The matriarch of Zaida’s family is unimpressed with her potential suitor, and demands a dowry that should prove impossible for him to deliver. But Rapayet figures out a way to fulfill the requirement: he gets involved in the marijuana business, forever changing the fate of the Wayuu tribe. Despite a high body count, the crime saga is anything but conventional.

A slow-burn, haunting story of family, honor, greed and capitalism, Birds of Passage is visually stunning and offers a fascinating look into the traditions of the Wayuu. (Laura Berger)

Docuseries of the Week: “Lorena”

Lorena Bobbitt became a household name in 1993 when she cut off her then-husband’s penis with a kitchen knife while he slept. Her shocking attack—and the fact that her trial was televised—made her an overnight news sensation. A four-part docuseries, Amazon’s “Lorena” sees Bobbitt telling her side of the story, and exploring how so much of the racist and sexist news coverage surrounding the case—and tasteless jokes on late-night TV—often ignored or minimized the fact that she claimed her husband, John Wayne, physically and sexually abused her. Dismissed as a “hot-blooded Latina” and a “jealous wife,” Bobbitt had many witnesses corroborate her account of her husband’s monstrous behavior.

Cheesy and unnecessary reenactments aside, “Lorena” offers a powerful portrait of a woman pushed to the brink—and a nation wholly unprepared to deal with its epidemic of domestic abuse. The docuseries provides a helpful historical overview of what services and legal recourse were available to abused women at the time, or more accurately, the lack thereof. Hopefully the rise of the #MeToo and #TimesUp movements will encourage Bobbitt skeptics to view the case through a new lens, and encourage all of us to do more for the millions of women who continue to be affected by domestic abuse. TV Movie of the Week: “Kim Possible”

No matter your age, chances are you’ll find something to love in “Kim Possible,” a new Disney Channel movie that’s also a Gen Z update of the beloved early-aughts cartoon. Kim is no longer animated, but she’s still everyone’s favorite straight-A student/crime fighter.

If you watched the original series, you’ll get a kick out of Christy Carlson Romano’s (i.e. the voice of the animated Kim) cameo, and the film’s many Easter eggs. If you think young girls need more ass-kicking role models like Buffy Summers, you’ll probably be delighted to see Alyson Hannigan—yes, Willow!—playing Kim’s brain surgeon mother. If you enjoy multi-generational stories about women, à la “Gilmore Girls” or “Jane the Virgin,” you’ll be psyched when Kim (Sadie Stanley), her mom, and her nana (Connie Ray) team up to take down the bad guys. If your favorite characters tend to be villains, you’ll bask in Shego’s (Taylor Ortega) scenes—between her side-eye and acid tongue, she pretty much steals the entire movie.

Most importantly, if you’re someone who appreciates a nuanced coming-of-age tale—especially one about a young woman in the midst of a huge life transition—“Kim Possible” delivers. Give or take the gymnastics skills and spy gadgets, we’ve all been in Kim’s shoes: the beginning of high school is rough, and figuring out your identity as a teen can feel impossible. But Kim makes her way through one shitty sitch after another and comes out the other side more confident than ever. Plus, she saves the world. (Rachel Montpelier)

This song is inspiring for anybody, where the superstar sings, “Sirens everywhere, singing that street song. Violence everywhere, barely holding on…” The song was produced immediately after the grand jury’s decision not to indict the officer involved in the death of Eric Garner. The three-minute long song begs for strength and peaceful protests. At the end of the video, Eric Garner’s face is shown.

 

 

8. We Shall Overcome

This song was made as a protest song, and became a staple song during the Civil Rights Movement. The song derived from a previous gospel song by Charles Albert Tindley. ‘We Will Overcome’ was published in 1948. Joan Baez performed the song live at the White House for President Obama.

 

 

9. Lift Every Voice and Sing- James Weldon Johnson

Also known as the “Black American National Anthem”, the song was first performed as part of a poem in 1900 in a segregated school in Jacksonville, Fla. Principal of the Stanton School, James Johnson, wrote the poem to honor guest speaker Booker T. Washington. The song has been redone by various artists including Ray Charles (his rendition below), Bebe Winans, Maya Angelou and Melba Moore. When Rene Marie was asked to perform the national anthem in 2008 at a civic event in Colorado, she caused massive controversy by swapping the words for the lyrics of Lift Every Voice and Sing. The Rev. Joseph Lowery also used lyrics from the song at President Obama’s inauguration ceremony in 2009.


10. Pride (In the Name of Love) – U2

A major hit for international sensations U2, this song become an anthem for peace, freedom and human rights. It was inspired by the civil rights movement and celebrates the legacy of Martin Luther King Jr.

 

11. Say it Loud, I’m Black and Proud – James Brown

The lyrics of this song focus on prejudice blacks in America have faced. It was released in two separate singles but both held the No. 1 spot on the R&B singles chart for six weeks. It also peaked at No. 10 on the Billboard Hot 100. The song quickly became a black power anthem.

 

 

12. I’ll Take You There – The Staple Singers

‘I’ll Take You There’ was on the Hot 100 for 15 straight weeks, and eventually reached the number one spot. The song is also looked at as a “call-and-response” type of song. While it was released in 1972, it still remains one of the most recognized and successful songs of the century.



 

13. When the Revolution Comes- The Last Poets

Released in 1970, right in the heart of the civil rights movement, after the death of Martin Luther King Jr. The song was extremely fitting, and definitely caused a frenzy.

 

14. Get Up, Stand Up- Bob Marley and Peter Tosh

Marley created this song during his Haitian tour, after seeing the poverty stricken country. The song is symbolic for standing against oppression, and is a international Bob Marley legendary hit.



 

15. The Times They Are A’ Changin – Bob Dylan

In 1964, Bob Dylan produced the album: The Times They Are A’ Changin, and the first song had the same title. The album consists of songs that address racism, poverty, and plead for social reform and positive change. One of his most famous songs is this one, and Dylan says it was a song with purpose.

Birth Justice: Where #MeToo and Medical Sexism Intersect

Never before have conversations about sexual harassment and violence been so commonplace. Around the world, feminists are declaring that they #BelieveWomen and women are telling their #MeToo stories. Despite a wave of fierce backlash to the feminist movement, we have broken the silence around the interpersonal and systemic violence that so frequently faces women, female-bodied, queer and trans people.

But I can’t help but notice a huge blind spot around birth.

UNICEF estimates that about 353,000 babies are born each day around the world—and in the process, thousands of birthing women experience violence. Birthing people are often coerced, threatened and violated during and after labor; they are separated from their babies, ignored by their doctors and forced into numerous other inhumane acts perpetrated by the patriarchal hospital system.

Doulas often say there is a “hidden epidemic” of doctors abusing women in labor—and in the last five years alone, women have begun to speak up about obstetrical violence. Caroline Malatesta won a lawsuit against the hospital where she gave birth after she suffered from PTSD and permanent nerve damage in response to the nurse forcefully holding her baby in her vagina while she waited for the doctor to come into the room. A woman known by the pseudonym “Kelly” sued her obstetrician for assault and battery after he conducted a multiple-cut episiotomy after she explicitly refused the procedure. 

But there are still millions of cases globally where the rights of birthing people are ignored—where their genitals are touched or cut without their consent, or their bodies are used in ways they explicitly refused. It is not uncommon to see doctors forcefully conduct vaginal exams on women during labor, even while they explicitly tell them to stop, for no medical reason whatsoever—a course of action that is, by definition, rape.

The #MeToo movement has openly grappled with the issues of privilege that shape its explosion. It takes privilege to stand up and say that one has suffered sexual harassment, abuse and rape. It is, in some ways, still a privilege just to be believed once you have spoken up. For every story told with the hashtag, thousands of stories go untold by women around the world because they fear greater violence or disenfranchisement. 

While every woman is vulnerable to obstetric violence, we are not all affected equally. Immigrants, people of color and poor folks are the least likely to be heard, and in many cases the most likely to be impacted, by birthing violence. In the U.S., black birthing people are dying in childbirth three to four times as often as white women. Latinx birthing people are dying twice as often as white women. 

My partner’s mother was raped when she went to her doctor for a routine prenatal checkup; she stopped going to that doctor, but didn’t report him to the hospital because race and class dynamics made her feel that nobody would listen. My grandmother is more willing to talk about the horrible atrocities she suffered during the Holocaust as a teenager than her first birth experience in a Brooklyn hospital in 1962—in which she was strapped to a bed, verbally abused and locked in a room alone during labor, and then separated from her baby for a week and discouraged from breastfeeding.

Unfortunately, although the vast majority of doctors have good intentions and want to take care of their patients as best they can, they work in a system that does not prioritize consent, that positions their patients as less knowledgeable about their own bodies than they are and that sets up a power dynamic where doctors can exploit their knowledge to get inappropriate access to their patient’s bodies. 

This violence is rooted in the history of the field: James Marion Sims, known as “the father of modern gynecology,” conducted experiments against female slaves without their consent and without anesthesia; today, medical students are still sometimes taught to perform pelvic exams on anesthetized women without their knowledge or consent—a practice that is only illegal in four states.

The midwifery model of care offers a much-needed alternative to western obstetrics. Midwifery, a century-old craft which means “with woman,” utilizes a model that prioritizes holistic female well-being. It is not only about keeping the birth safe—it is about keeping the birthing person feeling safe, and thus protecting the physiological process of birth.

We are all born, and medical research has concluded that birth affects us in deep, lasting and powerful ways. If mothers feel unsafe, violated or abused during births, their newborn babies will store those experiences in their nervous systems. Whether we are born through a cesarean section, vaginally in a hospital with an epidural or at home, our birth experiences affect us for the rest of our lives. 

Birth justice is finally becoming a part of the conversation, with states like New York and California creating initiatives to attempt to address the birth disparities facing communities of color—but we have so much more to do. We need to start calling obstetric violence what it is, and we need to start connecting the dots between #MeToo and medical sexism.

Men who are true allies to women need to be actively engaging with other men to end rape culture, and obstetricians must band together to stop obstetric violence. Men need to stop thinking that they deserve control over female bodie, and doctors need to stop thinking that they can do anything they want to our bodies under the guise of practicing medicine.
