‘Choose Your Own Adventure’ book publisher sues Netflix for $25M over ‘Bandersnatch’

Choose your own adventure Netflix

The big gimmick associated with Netflix’s buzzy Black Mirror movie Bandersnatch is that it’s very much a choose your own adventure kind of production. Viewers are presented with choices as the movie about a programmer working on a video game progresses, with the filmmakers reportedly having shot some 5 hours of footage to encompass all the potential alternatives that viewers can select.

Here’s one that neither the filmmakers nor Netflix likely hoped for, though. The book publisher behind the popular series of Choose Your Own Adventure books for kids has slapped Netflix with a $ 25 million lawsuit, claiming the Bandersnatch movie and its marketing infringes on the publisher’s arguably very well known trademark brand.

‘Choose Your Own Adventure’ is Suing Netflix Over ‘Bandersnatch’

If you thought Netflix’s Black Mirror: Bandersnatch was a lot like those Choose Your Own Adventure Books we read as kids, you’re not alone.

Chooseco LLC, which owns the rights to the Choose Your Own Adventure series of books is suing Netflix over Black Mirror: Bandersnatch, because the program “infringes on trademarks,” Variety reports. The publisher is seeking at least $ 25 million in damages.

Netflix was allegedly in negotiations with Chooseco to get the rights to the book series, rights that it did not acquire.

In the show, one of the characters even goes as far as to say it’s “It’s a Choose Your Own Adventure Book.”

And Chooseco isn’t the only one that could potentially sue Netflix over the program. 20th Century Fox is the owner of the movie rights to the series of books and also did not consent to the show.

In addition to Bandersnatch, Netflix also recently released a new original film, “BirdBox.” That film set a record for the streaming service, with more than 45 million accounts watching the film during its first week of availability.

Netflix faces lawsuit over ‘Black Mirror’ and ‘Choose Your Own Adventure’

TwitterFacebook

Black Mirror: Bandersnatch is on the receiving end of a lawsuit from the owners of “Choose Your Own Adventure” books.

Chooseco, LLC trademarked “Choose Your Own Adventure” in the 1980s and has sold hundreds of millions of books using the branding ever since. According to The Hollywood Reporter, Chooseco reported that Netflix sought to acquire this trademark but was never granted the license.

Per an excerpt of the official complaint, via THR:

Indeed, the phrase “choose your own adventure” has been almost inextricably linked to Bandersnatch, either through Netflix’s own efforts or the mark’s ubiquity as established by Chooseco. The company has filed for at least $ 25 million for “infringement, dilution, and unfair competition” and demands that Netflix remove any “choose your own adventure” references relating to Bandersnatch. Chooseco wants to be distanced from the darkness and morbidity of Black Mirror (honestly, so do we). Read more…

The Holiday’s Over… Er, Not for These Sun-Soaked Celebrities

Photo Illustration by The Daily Beast

A new year brings time for pause and reflection—plus the chance to follow celebrities on their jaunts to locations that are inevitably much warmer and more glamorous than wherever you are.

While many of us wasted our Jan. 1 ordering takeout and mindlessly refreshing Instagram, tabloid photographers were hard at work catching glimpses of stars frolicking on sandy beaches or selfie-ing aboard private yachts, with the emphasis on photographing as much (mostly female) flesh as possible.

The time-honored tradition of stalking celebrity getaways is crystallized by headlines like the Daily Mail’s, “Molly Sims shows off her jaw-dropping physique in racy clashing swimsuit during fun-filled family day at the beach in St Barts.” (Sims, like most insiders on the French Caribbean island, would probably spell it St Barth’s.)

Is The Smartphone Era Over?

NEW YORK (AP) — Behind Apple’s disconcerting news of weak iPhone sales lies a more sobering truth: The tech industry has hit Peak Smartphone, a tipping point when everyone who can afford one already owns one and no breakthroughs are compelling them to upgrade as frequently as they once did.

Some manufacturers have boosted prices to keep up profit. But Apple’s shortfall highlights the limits of that strategy. The company said demand for iPhones is waning and revenue for the last quarter of 2018 will fall well below projections, a decrease traced mainly to China.

Apple’s shares dropped 10 percent Thursday on the news — its worst loss since 2013. The company shed $ 74.6 billion in market value, amid a broader sell-off among technology companies , which suffered their worst loss in seven years.

Apple’s news is a “wakeup call for the industry,” said analyst Dan Ives of research firm Wedbush Securities.

And it’s not just Apple. Demand has been lackluster across the board, Ives said. Samsung, long the leading seller of smartphones, has been hit even harder, as its phone shipments dropped 8 percent during the 12 months ending in September.

“The smartphone industry is going through significant headwinds, “Ives said. “Smartphone makers used to be like teenagers, and the industry was on fire. Now it feels like they’re more like senior citizens in terms of maturity.”

Tech innovations in phones grew in leaps and bounds earlier in the 2010s, with dramatic improvements in screen size, screen resolution, battery life, cameras and processor speed every year.

But the industry is a victim of its own success. Innovation began to slow down around 2014, once Apple boosted the screen size with the iPhone 6 and 6 Plus models. While phones kept improving, new features tended to be incremental, such as a new flash technique to already excellent phone cameras. It’s the stuff consumers won’t typically notice — or want to shell out for.

“Since the iPhone 6 you’ve seen it has been tough to innovate to continue to raise the bar,” Ives said.

Apple customers now upgrade every 33 months on average, longer than the 24 or 25 months three years ago, he said.

Apple’s diminished growth projections, fueled by plummeting sales in China, have reinforced fears the world’s second-largest economy is losing steam. Its $ 1,000 iPhone is a tough sell to Chinese consumers unnerved by an economic slump and the trade war with the U.S. They also have a slew of cheaper smartphones from homegrown competitors such as Huawei, Xiaomi and Oppo to choose from.

The fact that even Apple’s iPhone juggernaut is suffering cements a larger trend for all major smartphone makers. After a steady rise for a decade, worldwide smartphone shipments fell 3 percent to 1.42 billion in 2018, the first annual drop, according to International Data Corp., which tracks such movements. IDC estimates that shipments will rebound 3 percent in 2019 to 1.46 billion, but that still falls short of 2017 levels.

It doesn’t help that top phones come with four-digit price tags — $ 1,100 for the iPhone XS Max and $ 1,000 for Samsung’a Galaxy Note 9. The top-end Max model sells for $ 1,450 in the U.S.

“They’re getting more and more expensive while offering fewer and fewer new, innovative features that I’ll actually use,” said Zachary Pardes, a tech-savvy 31-year-old in Fairfield, Connecticut. “I’ll upgrade when the battery stops working. When I’m forced to buy a new phone, I’ll buy a new phone.”

Vivian Yang, a manager at a Beijing technology company, also balked at the price. “Nobody needs such a phone,” she said.

IDC analyst Ramon Llamas said the cycle might bottom out and start growing again in 2021 or 2022, when people’s current phones start reaching the end of their useful life. “People will still replace their phones. It’s going to happen eventually,” he said.

But there’s no “silver bullet” that will spur growth to levels seen in the past when the industry was less mature.

Foldable smartphones , with screens that unfold like a wallet to increase display size, are one thing that could spur excitement, but they’re expensive and not due out until at least the end of the year.

Another thing that might spur growth: 5G, the next-generation that telecom companies are currently in the process of building, expected to be faster and more reliable than the current 4G network. The first 5G compatible phones are due out this year.

“There’s more pressure on 5G as the next-wave smartphone,” since sales are so lackluster, said Ives. “There will be a battle royale for 5G phones.”

But 5G will take years for broad, nationwide deployment, so the new 5G smartphones coming out this year are not likely to make much of a splash immediately either.

Analysts say smartphone makers need to push into under-saturated areas like Africa and elsewhere, and also sell more services like cloud storage, streaming music and phone software. But the glory days of untrammeled growth appear to be over.

“It’s going to be a slow slog,” Llamas said. “By no means is this the end of the smartphone market. But this is an indication that the smartphone market can be a victim of its own success.”

Iman Shumpert Avoids Jail Time Over 2016 DUI, Marijuana Possession

Sacramento Kings defender Iman Shumpert can start 2019 without worrying about jail time after a Georgia judge placed the NBA star on probation instead of behind bars.

The Blast reports Shumpert was sentenced over his 2016 arrest for allegedly driving under the influence of drugs, marijuana possession and failure to maintain the lane, on December 18.

Shumpert reportedly entered a plea of no-contest to the DUI and guilty for the failure to maintain lane. According to The Blast, court records state the marijuana possession charge was disposed due to a Conditional Discharge law that exists in Georgia allowing first time drug offenders to complete classes on substance abuse instead of paying a steep price.

Shumpert was placed on probation and his criminal case was closed.

Eliza Dushku Says CBS Fired Her After She Confronted Bull Co-Star Over Harassment

Eliza Dushku broke her silence about a $ 9.5 million confidential settlement she reached with CBS, saying the network fired her after she confronted co-star Michael Weatherly over his alleged sexual harassment on the set of the show Bull.

In a Boston Globe op-ed published Wednesday, Dushku detailed the harassment from Weatherly, which included comments about his “rape van,” name-calling, comments on her beauty, boasting about his virility, and a remark about having a threesome. She said CBS wrote her off Bull after she addressed Weatherly’s behavior with him directly.

Dushku’s essay comes after the New York Times reported that CBS settled her harassment claims for $ 9.5 million. While Dushku declined an interview for the Times story in order to honor the terms of her settlement with CBS, she wrote that she chose to speak out this week after seeing that Weatherly and Bull showrunner Glenn Gordon Caron had provided comments “in what amounted to more deflection, denial, and spin,” she wrote.

“The narrative propagated by CBS, actor Michael Weatherly and writer-producer Glenn Gorden Caron is deceptive and in no way fits with how they treated me on the set of the television show Bull and retaliated against me for simply asking to do my job without relentless sexual harassment,” she wrote. “This is not a ‘he-said/she-said’ case. Weatherly’s behavior was captured on CBS’s own videotape recordings.”

Representatives for Weatherly did not immediately comment on Dushku’s piece. In a statement to the Times, Weatherly said Dushku was uncomfortable with his “attempt at humor.”

“When Eliza told me that she wasn’t comfortable with my language and attempt at humor, I was mortified to have offended her and immediately apologized,” he said. “After reflecting on this further, I better understand that what I said was both not funny and not appropriate and I am sorry and regret the pain this caused Eliza.”

Dushku wrote that she dealt with sexual harassment and bullying from Weatherly “day-in and day-out” for 10 to 12 hours each day for weeks until she spoke to him about it. In response to her request that he “help ease the sexualized set comments” Weatherly said: “Eliza, no one respects women more than I do,” according to Dushku’s piece. Following that conversation, Dushku said she was written off the show.

According to Dushku, the bullying continued even through the settlement process.

“The boys’ club remains in full force at CBS,” she wrote. “In the settlement process, CBS used as defense a photo of me in a bathing suit, pulled from my own Instagram, as if this suggested I deserved or was not offended by the sexual harassment I experienced.”

Dushku’s essay comes as CBS faces other sexual harassment scandals. Her settlement deal with the network came to light during an investigation of former CBS CEO Les Moonves over accusations of sexual assault and harassment, including forced oral sex, groping and retaliation. Moonves was terminated for cause and will not receive $ 120 million in severance, the CBS board announced Monday. Former CBS co-anchor Charlie Rose and former 60 Minutes producer Jeff Fager were also fired in recent months over sexual misconduct allegations.

CBS confirmed Dushku’s settlement in a statement. The network said the amount she received reflects what she would have gotten for the balance of her contract as a series regular on Bull.

“The allegations in Ms. Dushku’s claims are an example that, while we remain committed to a culture defined by a safe, inclusive and respectful workplace, our work is far from done,” CBS said in its statement.

Bella Hadid Gushes Over The Weeknd – He Is The ‘Most Beautiful Person’ I Know!

Bella Hadid and The Weeknd seem to be happier than ever now that they are back together! That being said, while doing a 73 Questions video for Vogue, the supermodel revealed that her singer beau being such eye candy helps make it work as well!

The Hadid sister made it very clear that from her point of view, The Weeknd is very handsome.

In fact, when she was asked who the most beautiful person she knows is, Bella, smiled sweetly and let the world know that it’s her boyfriend!

But that is not even the only time she gushed over him during the interview!

Bella also claims that he is the one who makes her laugh ‘the hardest’ as well!

Handsome AND funny? What more could you want from a significant other?

But when it comes to feeling beautiful, the model made it very clear that instead of relying on the world or her boyfriend to tell her, it’s something she finds within herself!

‘Probably when I just feel healthy and confident in myself,’ she responded.

She went on to give aspiring models some great advice, saying that: ‘The hardest part of the modeling industry is gaining respect from my peers. I think, there is a lot of pretty girls out there, so if you cannot be kind and work hard, there is no reason to do it.’

As fans remember, Bella and The Weeknd reunited earlier this year.

They were romantically involved years ago, but in 2016, they pressed pause on their relationship for a while.

Ever since rekindling their romance, the two have been caught together in public a lot, enjoying their love like never before!

Hopefully, this time around it’s forever for the two!

Per the Daily Mail, the 16-year-old Backpack Kid (Russell Horning) is suing Epic Games for using his move, “The Floss” as an emote in the game. Though it is a one-time special reward made available in Battle Pass Season 2, players can’t actually purchase the move. The lawsuit has reportedly been filed by his mother on his behalf on Monday seeking unspecified damages against Epic games and Take Two, for its use in Fortnite and NBA 2K without permission or paying royalties.

Horning and The Floss became famous after he posted videos of himself performing the dance on Instagram, and reached a wider audience when he did the move during Katy Perry’s performance of Swish Swish on SNL in 2017.

Ariana Grande, Kanye West Feud Over Mental Health Turns Serious as Pete Davidson Posts Concerning Message

A Twitter spat between Ariana Grande and Kanye West over mental health took a serious turn on Saturday after Pete Davidson, an SNL star and Grande’s ex-fiance, posted a message on social media that some took as suicidal.

The tiff between the two musicians began when Grande waded into a feud between West and the music star Drake yesterday.

Drake and West and have notoriously had a contentious relationship since at least 2011, according to ELLE. Their feud was apparently reignited in September, when Drake made a snide reference to the sneakers West designs in a song. Then on December 13, Drake requested sampling a portion of Kanye’s song in one of his compositions. Soon afterward, Kanye launched into a Twitter rant that lasted more than 100 tweets.

Grande responded to the very public dispute with a teasing tweet of her own.

“Guys, I know there are grown men arguing online rn but miley and I dropping our beautiful, new songs tonight so if y’all could please jus behave for just like a few hours so the girls can shine that’d be sick thank u,” Grande wrote on Twitter, which she later deleted.

West did not take kindly to Grande’s intrusion and suggested that she was inserting herself into the beef to promote her new song, “Imagine,” which released Friday.

Grande then apologized for being insensitive about West’s mental health, but fired back at him for suggesting she was promoting herself.

“With all due respect, I don’t need to use anyone to promote anything. period. I was making a comment ab what men were doing at the time v.s. women. It was a joke which I understand now was probably insensitive. I apologize if I was in any way triggering and I hope u feel well today,” Grande tweeted. She later deleted her tweet.

This morning, Davidson appeared to side with West in an Instagram post.

“Bravo Kanye West for standing up for yourself and speaking out against [sic] mental health,” his post read. “I can’t explain to you enough how difficult and scary it is to be honest about stuff like this. We need people like Kanye. No one should ever point fingers at you for your bravery in speaking about mental health. I’m seriously disgusted.”

A few hours later, however, Davidson published another message that struck an even more serious tone.

“I really don’t want to be on this earth anymore. I’m doing my best to stay here for you but I actually don’t know how much longer I can last,” Davidson wrote.

Davidson, who has spoken out frequently about having bipolar disorder and suicidal tendencies, appeared to suggest that he was feeling suicidal. Soon afterward, he deleted both messages.

Earlier this month, Davidson wrote on Instagram:

“I’ve been getting online bullied and in public by people for 9 months. I’ve spoken about BPD and being suicidal publicly only in the hopes that it will help bring awareness and help kids like myself who don’t want to be on this earth,” he wrote. “No matter how hard the internet or anyone tries to make me kill myself. I won’t. I’m upset I even have to say this.”

In since-deleted tweets, Grande apologized for being insensitive about mental health issues.

“Man I’m so sorry I told a dumb joke. I really didn’t mean any harm. All I want everyone to be healthy and happy. so desperately,” she tweeted.

Soon afterwards, she tweeted seemingly at Davidson: “I’m downstairs and I’m not going anywhere if you need anyone or anything. I know u have everyone u need and that’s not me, but I’m here too.”

TMZ reported that she had made her way to 30 Rock in Manhattan, where SNL is filmed, in order to try and see Davidson.

Davidson was accounted for at SNL and “fine,” according to the New York Times.

Should the Oscars Fire Host Kevin Hart Over His Homophobic Jokes?

Photo Illustration by Sarah Rogers/The Daily Beast

Hosting the Academy Awards is an infamously thankless gig, exposing the emcee to intense scrutiny from the culturati and critics, typically with little to gain professionally in exchange. It’s gotten so bad that earlier this week, in response to the fact that dozens of celebrities had turned down the Academy’s requests to preside over this year’s ceremony, The Hollywood Reporter proclaimed hosting the Oscars “the least wanted job in Hollywood.”

That was, of course, mere hours before the Academy announced that comedian Kevin Hart had taken the job.

Hart actually wanted the job very much, and has been on record saying as much over the years. He announced that he was “blown away simply because this has been a goal on my list for a long time” when he shared the news on Instagram. And now that he’s gotten it, he’s already witnessing part of the aforementioned reality of the gig: the scrutiny.

Ya Think?: Cops Say Tekashi 6ix9ine Ratted Himself Out Over Ordering Hit On Chief Keef’s Cousin

Tekashi 6ix9ine live in Oslo, Norway.

Source: PYMCA / Getty

The hits keep coming with the Tekashi 6ix9ine case and this latest bit of news shouldn’t come as a surprise to anyone. Cops believe the alleged Bloods gang member ordered a hit on Chief Keef’s cousin in New York and video of him allegedly discussing the crime attempt.

TMZ reports:

TMZ broke the story … Tekashi FaceTime’d Keef’s cousin, Tadoe, in late May and repeatedly asked for his location. The conversation went down on camera, in broad daylight, and we posted that video last week. At the end of the convo, the Brooklyn rapper clearly says, “I got a 30 pack on him right now, Blood.”

The translation, we’re told, is putting a $ 30k bounty on someone. Law enforcement sources tell us … investigators working on the June 2 attempted shooting of Chief Keef are now convinced 6ix9ine ordered the hit.

As we reported, someone opened fire on Keef while he was outside the W Hotel in Times Square. We’re told Tadoe was standing nearby at the time — and the “30 pack” video changes NYPD’s perspective on the shooting.

One law enforcement source said, “This is no coincidence. We believe the video is directly related to the crime. We believe Tekashi69 ordered the hit on Tadoe — who we now believe is the intended target.”

Charges have not been filed in the case but NYPD do have two persons of interest including one person connected to Tekashi.

Jessie J: ‘I Am So Disappointed and Embarrassed’ Over Jenna Dewan Comparisons

Jessie J is not here for your comparisons. The “Domino” singer addressed the attention she’s received as of late from fans who would liken her to boyfriend Channing Tatum’s ex, Jenna Dewan, on social media.

“I rarely, but sometimes see that my name is involved in stories online that I do not agree to,” the Singer 2018 winner, 30, began a lengthy Instagram post on Friday, November 16. “I often ignore them at 99% of the time it is something that doesn’t serve any positivity to speak on. However there is a story I have seen be written over and over again in the past few weeks that talks about myself being directly compared to another beautiful woman regarding our looks and people picking who they think is prettier. I am here to talk about the headline and the way the story has been written, I have continuously tried to find something positive from this article … I am yet to.”

She continued, “Who feels good from this story? I know I don’t … Is picking who is prettier and then continuing to say why a good activity for women to participate in? No … I am so disappointed and embarrassed that my name is even involved. It’s not something I stand for, at all.”

The musician shared why the comments bothered her so much, adding, “I spent so much of my childhood trying to be comfortable in my skin just like so many other little girls … I am a woman that supports ALL Women. I am a woman that loves ALL women and will not stand quietly when the media is teaching young girls to constantly compare who they think is prettier.”

“Be sensitive with your words. Be kind with your words. You have no idea what they can do to someone,” she wrote in closing.”

Dewan, 37, also made her thoughts on the matter known, responding to her ex’s paramour in an Instagram Story on Friday. “Amen Jessie! Yes!!!!” she wrote. “Women Women for women all the way. No need for negativity. Let’s live in a world where we support each other and lift each other up. Like I said before, positive vibes all the way. Nothing but respect.”

Us Weekly exclusively broke the news that Jessie J was dating Tatum, 38, in October. “It’s new, casual and they’re having fun together,” a source told Us at the time.

The Magic Mike star gushed over his lady love publicly for the first time after her concert at Royal Albert Hall in London on Tuesday, November 13.

“This woman just poured her heart out on stage at the Royal Albert Hall,” he wrote on Instagram. “Whoever was there got to witness something special. Wow.”

Earlier Friday, Jessie also made it clear that she doesn’t care what others think of her personal decisions with an Instagram Story. “I have noticed. Some people convince themselves I’m failing, or making the wrong decisions ect by the expectation they have for me, or what they would do if they were me,” she wrote. “You are not me. I often don’t want what you want for me for me. Lol.”

“I am happy with where I am,” she continued. “Who I am. What I am doing and how I am learning You are actually creating your own disappointment through something I never said I wanted. Let me live. Focus on you.”

DWTS’ John Schneider Gets Emotional Over His Strained Relationship with His Children

John Schneider is hoping he can mend his strained relationship with his three children.

In an exclusive clip of Monday’s Dancing with the Stars, the Dukes of Hazzard alum, who played Bo Duke on the comedy series from 1979-85, gets emotional while explaining how country music and DWTS has affected his life.

“What country music means to me is it’s three chords and the truth and it shines a light on things that happen in everyday life that are wonderful, not so wonderful, and that are heart-wrenching,” Schneider, 58, says.

“I’ve been going through a divorce now for four years and it’s awful. The worst part about it is that it’s wedged itself in between my three adult children and myself. Nothing I can do except hope one day one of my kids will call me up or show up. I look in the crowd every Monday thinking maybe tonight, maybe tonight.”

“If it weren’t for this music and now Dancing with the Stars, I don’t think I can survive it,” he admits. “It gives me great joy at a time where I desperately needed it.”

Earlier on in the season, Schneider briefly spoke towards his relationship with his children. whom he is not on speaking terms with.

“I’m hoping that I will do my family proud, I’ll do my love over there proud,” said Schneider told host Erin Andrews, referencing his girlfriend, Alicia, and added, “and maybe my children will speak to me again.”

After 21 years of marriage, Schneider’s estranged wife Elvira “Elly” Schneider filed for divorce in Los Angeles County on Nov. 14, 2014. She cited irreconcilable differences as the reason for their split, according to court documents.

In September 2016, Schneider — he shares adult children Leah, Chasen, and Karis with Elvira — was ordered to pay his ex $ 18,911 every month, TMZ reported.

But in June, Schneider was sentenced to three days behind bars in the Los Angeles County Jail in June for failure to pay more than $ 150,000 in owed alimony payments to Elvira. The actor was released on the same day as his initial booking because of California’s overcrowded prison system, but his legal woes were not done with that.

Schneider was also ordered to serve an additional 120 hours behind bars for contempt, but that sentence was suspended by the court on the condition that he fulfills a four-part list of conditions, including filing back taxes to help clear title to their property in Apple Valley so that it could be transferred to her, paying his ex half of his owed earnings from Maven Entertainment, and offering certain financial disclosures before the end of the year.

Dancing with the Stars airs Mondays (8 p.m. ET) on ABC.

These Millennials Have Invested in Real Estate All Over the Country. Here’s How

At just 35 and 29, Christopher and Meghan Miller are semi-retired.

The couple, with their infant son, Ben, recently quit their jobs and moved from Columbia, Maryland, to Berryville, Virginia — a town of approximately 4,000.

Their new home is perched on two acres. Across the street is a horse farm. Down the road is an organic farm where Christopher harvests produce twice a week. He’s paid in vegetables, which Meghan, an enthusiastic cook, plans meals around.

“We’ve just embarked on this semi-retired adventure of doing work we really enjoy and value instead of doing work that just has the highest salary or because we have to,” Christopher said.

The couple has worked hard to afford this new phase of life. Christopher, a former systems engineer, and Meghan, a former high school English teacher, built up their savings and sources of passive income, mostly through real estate investments.

In addition to four rental properties, the couple has invested in a diversified portfolio of real estate projects across the country — from Washington, D.C. to Los Angeles — through an automated investment experience.

“I don’t have to manage them; I don’t have to do the work to improve the properties; I don’t have to find tenants, evict tenants,” Christopher says.

Unlike traditional real estate investments, the Millers back these national building projects through an online platform called Fundrise. Since 2016, Fundrise has paid dividends each quarter. (Note: As with any investment, past performance isn’t indicative of future results.)

Living off of Passive Income

Real estate piqued Christopher’s interest about 12 years ago when he read “Rich Dad Poor Dad” by Robert Kiyosaki and Sharon Lechter. The book emphasizes the importance of investing, particularly in real estate.

In 2006, while still in college, Christopher purchased a rental home in Elkridge, Maryland.

“It was kind of a roller coaster,” he says. “At first I thought, ‘Man, this investing in real estate is really easy.’”

The first property’s value had increased 20%, so he purchased another house in 2008.

Then the market crashed.

By 2009, he was under water on both properties. He had purchased the first home with an interest-only mortgage. “It was a really bad loan that plagued the investment even more after the market crash,” he said.

After recruiting roommates, he lived in one house for free for about five years. (He also met Meghan in that neighborhood, so it all worked out.)

Still, he owed money.

In 2013, Christopher started feeling less gun shy about the real estate market, so he purchased a third rental. Then, a few years later, he and Meghan purchased several flip properties.

“It’s been a wild ride,” he says. “The passive income and making money while I sleep — I love that about real estate.”

In April 2016, he found an easier way to invest in real estate — one that didn’t require sweat equity, tenants and all the horror stories that come with owning rentals.

He could drop in as little as $ 500 and invest in properties across the U.S. through an online investment platform called Fundrise.

“I view our investments in Fundrise as something even more passive than the rental properties we own,” Christopher says.

Invest in Real Estate Online

Fundrise was launched in 2012 by two real estate investors and brothers. It aims to give everyone a chance to invest directly in real estate. It cuts the unnecessary middlemen, enabling it to offer low-fee diversified real estate investments to anyone with a computer. (There’s a 0.85% annual asset management fee and a 0.15% annual investment advisory fee.)

More than 200,000 Fundrise members are on the platform today, and Fundrise has invested in approximately $ 2.5 billion in real estate since its 2015 launch. Think of it like this: Fundrise is crowdfunding for new real estate projects across the country. Investors can hop in with as little as $ 500 or much more.

Taking Some of the Complexity out of Real Estate Investing

Investing in anything involves risk. But since 2014, Fundrise has seen historical returns of 8.7% to 12.4%.

For Christopher and Meghan, the online experience is a lot less weighty than those traditional real estate investments.

For example, remember the housing market crash of 2008 and how Christopher found himself under water on his properties? He finally sold one of those a few months ago — after 12 years of hanging on. He said it almost wasn’t worth the effort.

With Fundrise, Christopher can easily invest in real estate through the online platform, which puts his money into various income-producing properties, leaving him with a diverse portfolio of investments — from apartment renovations in Ann Arbor, Michigan, to stabilized apartments in Colorado Springs, Colorado.

Making Real Estate Investing More Accessible — Even in L.A.

Christopher and Meghan follow the progress of each project they’ve invested money into through Fundrise, thanks to regular email updates. Each email features photos and videos, updating them on new, completed and in-progress projects.

“The emails help remind you that you’re actually investing in something real,” Christopher says. “Like a condo in D.C. or a single-family home in L.A.”

Getting Started With Fundrise

Christopher receives automatic payments directly into his checking account.

Because Christopher and Meghan don’t need the money right now, they can use the software to easily reinvest any dividends they may receive, putting it right back into projects.

The Fundrise Starter Portfolio is currently open to all investors and requires $ 500 to start. There’s a 90-day satisfaction period, so if you’re not happy, Fundrise redeems your investment at the original amount*. If you invest $ 1,000 or more, you can select one of the advanced plans –– Supplemental Income, Balances Investing or Long-Term Growth.

Moving Forward and Affording a Semi-Retired Lifestyle

As Christopher and Meghan settle into their new home in Berryville, Virginia, they find ways to piece together their income without full-time jobs.

Christopher does part-time landscaping and tree work on the side, which results in profitable firewood. Meghan has plans to write freelance. They also have a steady income stream thanks to their rental properties.

They say they’ll take out money from their investments if they need, but so far that hasn’t been necessary.

Chrissy Teigen Hits Back at Mom-Shamer Over Breastfeeding Question

Chrissy Teigen doesn’t have time for the haters — especially when it comes to her kids with husband John Legend.

The Lip Sync Battle cohost hit back at a mom-shamer who tried to slam her for not breastfeeding in the comment section of the “All of You” crooner’s Instagram post on Monday, November 5.

“Wild scene backstage at @nbcthevoice,” Legend, 39, captioned a pic of Teigen, 32, bottle-feeding their 5-month-old son, Miles, while the model’s mom, Vilailuck Teigen, snuggled with their 2-year-old daughter, Luna.

One commenter was quick to ask, “You no longer breastfeed?” to which Teigen hilariously responded.

“John never breastfed Miles,” the Sports Illustrated Swimsuit model quipped in response, referring to the fact the comment was made under her husband’s picture.

Teigen is no stranger to clapping back at social media trolls who enjoy picking on her. Earlier this year, the Utah native put a hater in their place after the woman made a comment about her appearance less than four months after she gave birth to her second child.

“You look beautiful but you should grow your hair long again,” a follower wrote underneath a series of pictures Teigen shared from a late-night talk show appearance in October. “Girls with round faces should not have short hair like that. It makes your face looks huge. Been there….believe me….LONG HAIR.”

Teigen responded: “@bcnjw honestly wow thank you because when I wake up each morning I wonder what @bcnjw would do and then I try to make her happy. So this was a mistake on my part.”

Weeks prior, the Cravings author shut down speculation that she and Legend — who tied the knot in September 2013 — were expecting another child.

“I’m asking this with the utmost respectful, but is @chrissyteigen pregnant again?” a Twitter user commented about a photo of Teigen from the 2018 Emmys in September.

“I just had a baby,” Teigen hit back. “But thank you for being soooo respectful.”

How Basketball’s Fight Over Racial Equality Remade the Game

Photo Illustration by Lyne Lucien/The Daily Beast

Dr. James Naismith’s final student before he retired from the University of Kansas was John McLendon, the pioneer of fast-break basketball, the full-court press, and the four corners offense. Yet McLendon never received the credit he deserved, because the majority of his work was accomplished at historically black colleges and universities when basketball was still segregated in the United States.

Long before civil rights legislation began to rid America of the scourge of segregation, McLendon was utilizing basketball to break down racial barriers. In March 1944, McLendon orchestrated a “secret game” between his team, North Carolina College for Negroes (now North Carolina Central University), and a collection of white former college basketball stars from Duke University Medical School, who had handily beaten the Duke varsity team in a scrimmage. McLendon planned the game for a Sunday morning, when most people would be in church. The medical students borrowed cars from friends and drove a circuitous route to the school to avoid being detected, arriving with their jackets pulled over their heads. They hustled into a locked gym, where McLendon’s Eagles trounced them 88–44. There were no spectators.

“Coach Mac” went on to mentor countless African American coaches, among them Southern University coach Ben Jobe, Clarence “Big House” Gaines (who led Winston-Salem State University to a Division II NCAA championship in 1967 on the strength of a young guard named Earl Monroe), and former Georgetown coach John Thompson, who became the first African American coach to win a Division I championship.

Taye Diggs Sued By Ex-Manager Over Unpaid Commissions

Taye Diggs is reportedly being sued by the former management company that he fired over unpaid commissions.

Authentic Talent and Literary Management claims the actor owes them money for closing deals to get him on shows like All American and Beauty and the Beast. They also allege that they bagged on his behalf “a slew of endorsement deals.”

According to THR, Diggs and ATLM began working together in June 2015, according to the complaint, and the parties agreed that the “Empire” star would pay the firm 10 percent of his industry-related income.

Deadline shares the details:

The actor’s Deep Down Productions also is a defendant in the suit filed today in Los Angeles Superior Court. Authentic says it is owed “substantial sums of money” and that “these sums continue to accrue.” “Plaintiff has made repeated efforts to obtain payment from Diggs in order to avoid litigation,” the suit says. “Regrettably, however, Diggs has failed and refused to abide by his obligations hereunder and to tender commissions and post-termination commissions and other payments due and owing Plaintiff.”

The filing says Diggs hired Authentic to manage his career in June 2015 and that Authentic performed “exemplary” services until he fired the firm in late July. “Diggs has wrongfully failed and refused to abide by his legal obligations to pay Plaintiff commissions in connection with the numerous deals and employment obtained during the parties’ management relationship, including but not limited to the following: the All American, Beauty and the Beast, Crossovers, 25 Words or Less and [multiple] endorsement deals.”

ATLM is suing for breach of oral contract and wants the court to order an accounting of Diggs’ compensation in order to determine the amount of damages.

‘Enough Is Enough.’ It’s Time to Decertify USA Gymnastics or Start All Over Again, Gymnasts Say

The U.S. women’s gymnastics team enters the world championships in Doha, Qatar, this month as the defending team champions. American women have dominated the top of the podium at the last three championships, and five-time Olympic medalist Simone Biles is competing for her fourth all-around individual world championship title. She also qualified in all six events at the championships, and if she earns gold in each of them, could become only the second female gymnast to sweep all of the titles at a single meet since the 1980s.

But USA Gymnastics, the national federation for gymnasts for which she competes, is mired in one of the worst sexual abuse scandals in sports history. And its response to the revelations that team doctor Larry Nassar abused hundreds of athletes, including Biles, has prompted many leading many gymnasts to call for the U.S. Olympic Committee (USOC) to decertify USA Gymnastics, or at least remove everyone associated with the organization during Nassar’s years of abuse, and start all over.

“Enough is enough,” Aly Raisman, who was among the first Olympic team members to reveal she was abused by Nassar, tells TIME. She says the board of USA Gymnastics has been making “mistakes over and over again. And I think we have given them enough time. We can’t wait any more. It’s not right.”

Those calls grew louder last week after Steve Penny, the organization’s former president, was arrested on vacation with his family following an indictment for tampering with evidence relating to the Nassar scandal. His attorney said Penny was not aware of the warrant and is confident that his actions were not criminal.

Then, Mary Bono, the second person appointed to replace Penny, resigned after less than a week when it was revealed that her law firm represented USA Gymnastics and reportedly helped to provide a cover story for explaining Nassar’s absence after initial reports of his abuse. She also faced criticism from athletes including Biles for a now-deleted tweet from September in which Bono covered a Nike logo on her golf shoes in response to Colin Kaepernick’s Nike ad.

USA Gymnastics did not respond to requests for comment, although it did issue a statement regarding Penny’s arrest that said the organization “support[s] law enforcement’s efforts and [that it has] fully cooperated with the investigations by the Texas Rangers, Congress and others and will continue to do so to help the survivors and our community heal from this tragedy.” In announcing Bono’s departure, the USA Gymnastics board said in a statement that it was “in the best interest of the organization.”

In addition, USA Gymnastics refuses to settle any of the numerous lawsuits it faces from gymnasts including Raisman and Olympic teammates McKayla Maroney, Kyla Ross and Jordyn Wieber, all of whom were abused by Nassar and say that the organization failed to protect them by allowing him to continue to serve as national team doctor, even after receiving reports of his abuse.

“I was always concerned about how this was handled by USA Gymnastics, but now I feel it’s really dangerous,” Raisman says. “USA Gymnastics has not been transparent at all. There have been so many resignations, and no answers. They won’t release anything, which is making me more nervous about what else they are hiding.”

It’s now clear that the U.S. women’s gymnastics team’s dominance at world and Olympic competitions in recent decades came at a price. The entire five-woman 2012 Olympic team and four of the five-member 2016 team have revealed that they were sexually abused by Nassar, an osteopathic doctor. Over a period of more than a decade, he abused more than three hundred athletes under the guise of medical treatments. According to his victims, the abuse occurred at his office at Michigan State University where he was on the faculty, in hotel rooms during competitions and at the national training center at the Karolyi Ranch in Texas. Nassar is currently serving up to 175 years in prison for his crimes.

The USOC currently recognizes national governing bodies for sports like gymnastics, and that means USA Gymnastics adheres to bylaws established by the Olympic Committee concerning proper conduct of athletes and coaches, and compliance with its policies, which include anti-doping rules. USA Gymnastics also receives funding from the USOC to support the elite competition teams that represent the U.S. at world and Olympic events. Perhaps most importantly, many international sports federations that put on competitions such as world championships and oversee participation at the Olympics require national federations like the USOC to sponsor teams from their respective countries.

For USA Gymnastics to be decertified, a complaint would have to be filed by the CEO of the USOC. Once a complaint is brought to the USOC board, a hearing would be held including, in this case, members of USA Gymnastics and the athletes’ advisory council. The panel would then make a recommendation about whether to revoke recognition as gymnastics’ governing body. If another organization were to come forward to be recognized by the USOC, it would need a different name and would have to adhere to the bylaws of the USOC and start to gain membership of local gyms. If an alternate organization is not available to take over for USA Gymnastics, then gymnasts would temporarily compete under the umbrella of the USOC. However, if the USOC decertifies USA Gymnastics, it’s not clear whether the Federation Internationale de Gymnastique (FIG) would recognize American gymnasts at international competitions.

While unusual, there is precedent for decertification. The national governing bodies for taekwondo and team handball were decertified, and new organizations were created to replace them. In taekwondo’s case, the prior organization failed to address financial problems after USOC audits, and in team handball’s situation, USOC felt the existing management was not fulfilling its obligation to grow and populate the sport adequately.

The USOC did threaten USA Gymnastics with decertification, after it learned that Penny had waited five weeks before reporting reports of sexual abuse by Nassar to law enforcement. That led to Penny’s resignation, as well as the resignation of three top board members. But many survivors, including Raisman, want transparency from USA Gymnastics, including an explanation for why Nassar was allowed to continue to abuse gymnasts even after complaints about him were provided to its leadership, as well as explanations for the recent series of resignations.

“This is bigger than one abuser,” Raisman says. “It’s the leadership at USA Gymnastics that is creating this disaster.”

Raisman isn’t sure if decertification is the best option, but says something must be done to fundamentally change USA Gymnastics.

Nassar is in prison for his crimes, Penny resigned and the top three members of the USA Gymnastics board also stepped down. But, Raisman says, not much has actually changed at the organization. It has not acknowledged the scandal nor taken responsibility for what happened to hundreds of gymnasts who trusted that the governing body would have their best interests in mind and keep them safe.

“Some of the same leaders who were there [while Nassar was the team doctor] are still there. The old influence, the bad influence that created the problem, is still there,” she says. “They didn’t listen to anything we said; they never did and still are not doing it.”

In its statement announcing Bono’s departure, USA Gymnastics said it “remain[s] steadfast in our efforts to fundamentally transform the organization at all levels to ensure athlete safety and well-being is at the heart of everything we do…While we have made progress, we have much more work to do. This board is determined to take the necessary steps to support a safe, inclusive and competitive environment where all our athletes and members can grow, have fun and achieve their goals.”

Since the survivors came forward en masse to provide victim impact statements at Nassar’s sentencing hearing in January, Kerry Perry, who was the first president appointed to succeed Penny, was called before Congress to explain how Nassar was allowed to abuse gymnasts for years, despite reports to the organization that he was a sexual predator. Rather than providing an explanation, however, she redirected the focus to her intention to “make sure we’re focusing our organization on athlete safety.” Perry resigned in September after nine months leading USA Gymnastics.

The board then appointed Mary Lee Tracy as development coordinator to oversee training for gymnasts working toward making the elite world and Olympic teams. In December 2016, Tracy had defended Nassar, calling him “amazing” although he had been charged with child sexual abuse and indicted on federal child pornography charges days before. Tracy defended her description, saying she was only referring to her own experience with Nassar and that her comments had “absolutely nothing to do with … the survivors.” When Raisman tweeted that Tracy’s appointment was a “disappointment,” Tracy attempted to reach out to the Olympian and was asked by USA Gymnastics to resign three days into the job.

“I wonder how many more times does somebody have to do something harmful that hurts, actually hurts children and affects them in potentially life-threatening ways before somebody does something?” says Jessica Howard, a rhythmic gymnast who was abused by Nassar. “It hurts me as a victim; it’s a gut punch every single time.”

Howard says that the constant poor leadership decisions and resignations, and the arrest of Penny, are only perpetuating the pain and frustration for survivors. The message from USA Gymnastics, Howard says, is that athletes’ interests are still not the top priority for the organization. “I thought, this can’t be real,” says Howard when she read about the board’s decision to appoint Bono as interim president and CEO. “Maybe I’m having a dream — I actually thought that maybe I was having a dream. They cannot be this oblivious. It’s like screaming fire and nobody comes, and there are people in the building.”

Part of the problem, say many survivors, is that the organization has failed to take responsibility for the scandal and in doing so, damaged its reputation. “No one with any integrity is willing to take the position of leadership at USA Gymnastics,” says Rachel Denhollander, who was the first to identify herself as a victim of Nassar. “For two and a half years [USA Gymnastics] has consistently demonstrated that they have no desire to do the right thing.”

For one, she and others point to the fact that Ron Galimore continues in his position as chief operating officer at USA Gymnastics. According to email exchanges in the summer of 2015 that were obtained by the Indianapolis Star, an attorney from Bono’s firm suggested that Galimore be tasked with telling the USA Gymnastics’ medical team that Nassar was absent from competitions because he wasn’t feeling well – rather than informing them that Nassar was under investigation for sexual misconduct. USA Gymnastics did not respond to a request for comment on Galimore and his alleged involvement in the Nassar scandal.

“What people need to understand is that this is not a Larry problem — Larry is a symptom of a USA Gymnastics problem,” says Denhollander. “And they have not taken care of the root problem; they have only taken care of one of the symptoms.”

USA Gymnastics cites its adoption of SafeSport policies, created by the USOC’s U.S. Center for SafeSport. It’s meant to be an independent body that can investigate allegations of sexual misconduct, but many athletes feel that isn’t enough. Raisman, for one, advocates creating an entirely independent body — not affiliated with the USOC or its various sports governing bodies — to which athletes can turn for support and safety. She is working with Darkness to Light, a non-profit that provides education to adults to help them recognize signs of childhood sexual abuse, and wants to come up with other potential solutions for keeping athletes safe not just in gymnastics but all sports. “I never imagined it would get this bad,” she says.

Denhollander is hoping that Congress, which passed the Amateur Sports Act that created the USOC oversees the national governing bodies for the various sports, will hold the USOC accountable in a more stringent way. “Congress has to act to make a difference,” she says. “There is no way forward otherwise with this organization. Until all of those people who participated in the abusive culture that led to the worst scandal in recorded or Olympic history are gone, things are not going to be done differently. That’s the reason the current board is continually making the wrong choices. It’s not an accident.”

In the absence of more positive action from USA Gymnastics, the USOC, or Congress, Raisman feels an urgency to become an advocate for change herself, especially with the next Olympic Games only two years away. “I think about them a lot,” says Raisman of the gymnasts competing at the world championships in Doha, who are aiming to make the Olympic team in two years. “When I was training for the Olympics and realized what was happening [with the way complaints against Nassar were handled] was wrong, it was hard to work for an organization that I knew was very corrupt. And now with everything that has come out, it’s way worse than I ever imagined it would be. But it’s not the survivors’ fault. It’s the organization’s fault. The moment they realized something was wrong, if they had handled it the right way, and reported it, this wouldn’t be a problem right now. I’m trying to brainstorm ideas,” she says. “We owe it to the sport. The sport deserves much better.”

Why Instagrammers Are Going Wild Over These Debt-Free Coloring Charts

In 2009, Heidi Ifland Nash and her husband were paying off $ 38,000 of debt.

They’d been working on it for several years. At one point, Nash wanted to see tangible progress, so she decided to track their payments on paper with a chart she could color in as they inched toward their goal.

“The very first chart I made was just a big square with lines,” she said, laughing. “I said, ‘This is so boring! I’m gonna put some words on it.’”

She typed the words “debt free” in white text over a black box and added evenly spaced lines from top to bottom. She divided her debt by the number of lines and added the increments to the side. It was the first official Debt Free Chart.

“I was looking for something more inspiring than just the big ugly square that I’d made, and the thermometers just didn’t do it for me,” she said. “[They] just felt like a guilt-based fundraiser.”

Then, she uploaded her chart in the Living Like No One Else forum for people paying off debt. Soon, people started asking for personalized charts.

“I was custom-making everyone’s numbers,” she said. “It didn’t occur to me for months to make ones with just lines and no numbers on the side.”

From there, people asked for different words. First was “car loan.” Other types of loans followed. The first 16 to 20 designs came from requests from the forum.

Nash wanted to make them available to anyone, so she uploaded them to a Blogspot blog in 2010. Then, she forgot about them.

Over the next seven years, Nash had no idea that word of her charts was spreading on social media and Pinterest. People were downloading them constantly.

Why Coloring Can Help You Reach Your Goals

Studies have shown that envisioning yourself doing something can help you actually accomplish it.

People often make vision boards with pictures of trips they’ll take or the car they’ll upgrade to once their debt is gone. But a vision board celebrates future achievements. It’s just as important during the journey to remind yourself of what you’ve already accomplished.

That’s what Debt Free Charts offer. They make the stale process of paying off debt interactive. Every payment is a celebration of moving one step closer to that vision board goal.

Now, almost a decade after Nash uploaded her first chart, when you search through the #debtfreecommunity on Instagram, it won’t take you long to find photos of brightly colored pages with the words “credit card,” “student loan” or “emergency fund.”

“It’s a great visual motivator to keep going,” said Michelle Brady, who’s using the car fund, credit cards and savings challenge charts.

How Debt Free Charts Got a New Life

In December 2017, Nash got a chart request. It was the first in a while.

She had become debt-free and gone on to home-school her kids while trying various entrepreneurial ventures in the years since she’d uploaded the charts.

After checking her blog, Nash realized the file storage system and a lot of the links to charts weren’t working. So she moved the charts their own website.

She got the idea to post pictures of people with their charts. She knew some YouTubers had filled out the charts, but she didn’t know what to expect beyond that.

What she found were hundreds of pictures on Instagram with the hashtag #debtfreecharts.

“It’s kinda taken on a life of its own,” Nash said. “It’s doing things I never expected it to do.”

Nash never expected her first Debt Free Chart would turn into the more than 80 she has on her website now. Most cost $ 1, but 20 are free.

At $ 1 each, she isn’t looking to get rich on chart sales. She wants to break even for the cost of running the website. She’d rather use the popularity of the charts to give more away for free.

Nash’s goal is to give out 150,000 free charts in 2018 — and she’s already 50,000 charts toward her goal.

Which ones are her favorites? She loves seeing people post their finished starter emergency fund charts.

“It’s such a ‘Wow, I can do this’ moment for people when they fill that one out,” she said.

Another favorite is the adoption fund chart.

She’s also starting to run challenges to help people meet their savings goals faster. She wants to create a sense of community among those paying off debt.

“You see their joy and relief, and you see the pride in the work that they’ve done to pay off the debt,” Nash said. “It’s something I never expected to feel.”
